From: Community Services Director Kilsdonk Date: October 11, 2011 RE: Volunteer Policy Background: Policy with regard to the Town's volunteer program and the need for background checks was discussed at the October 12, 2010 Town Board Study Session. At that time staff was directed to review the statutes and bring forward additional information. At the November 23, 2010 Study Session, DTA Richardson presented research on volunteer background checks, safety and liability. This work included, but was not limited to, consultations with Town Attorney Greg White and CIRSA Attorney Tami Tanoue, and a review of the Breckenridge Volunteer Manual, considered an example of best practices. DTA Richardson reported that whereas Town volunteers acting within the scope of their duties are afforded the same liability protection as employees, when volunteers fail to conduct themselves within the scope of their defined duties, they face exposure to personal liability if a claim is filed. Staff recommended adopting five practices to the management of all Town of Estes Park volunteers: 1. An adequate selection and screening process. 2. Job descriptions for volunteers 3. Adequate routine training for volunteers. 4. Waivers or release of liabilities. 5. If partnered with a volunteer group, a written agreement is recommended. At that time, Trustee Koenig suggested establishing processes for all volunteers that would include volunteer benefit information, general Town information, and an outline of volunteer responsibilities and expectations. Attached for Town Board review is a draft volunteer manual for the Town of Estes Park. The manual addresses background checks, liability and indemnification, including a Volunteer Release of Liability and Indemnification form which has been reviewed by Attorney White. Contingent on feedback from the Town Board, staff would like to move forward with implementing the manual in January, 2012. Staff is developing Memoranda of Understanding with Town -affiliated volunteer organizations and would like to use the manual in conjunction with that process. The Creative Sign Program provides ` Y ire flexibility in the application of the Sign Code and encourages high - quality materials and workmanship for signs that make a positive visual contribution to the community. The program is also intended to encourage signs of unique design that exhibit imagination and inventiveness. The Creative Sign Design Review Board is responsible for reviewing creative sign program applications, sign variance applications, and appeals of staff sign code decisions. Initial appointments include two one-year terms, including one term filled by a local business owner; one two-year term filled by an architect or design 7 professional; and two three-year terms, including one term filled by a local business owner. When the Town of Estes Park became a Tree City USA in 1997, the Town Board recognized the importance of trees by creating the Tree Board. In addition to advising the Town Board on matters of public safety, the Tree Board works to help residents appreciate the value of trees, maintain the health of their own trees, and add to the beauty of the Estes Valley by planting trees as gifts or memorials. The Estes Valley Board of Adjustment is a joint Town/County board that reviews variance requests within the Estes Valley. The board consists of five appointed members. Two members are appointed by Larimer County; three members are selected by the Town Board; one alternate member is jointly appointed by the Board of County Commissioners and Town Board. Members must reside in their respective areas of the Estes Valley. When vacancies occur, residents may apply to serve on the Board by contacting the Community Development Department at 970- 577-3725. Appointments are made following application and an interview process. Interested residents are encouraged to participate in the Town's Citizen Information Academy program. The Estes Valley Board of Adjustment meets on the first Tuesday of the month at 9:00 a.m. in the Municipal i wilding Board Room. The board dopts and oversees the budget, bylaws and policy; conducts strategic planning; and hires and evaluates the library director. It delegates authority and accountability to the library director who operates under policies set by the board. Trustees are volunteers:jointly appointed by the Town Board and Larimer County for staggered terms of four years. The Library Board meets twice a month, usually the first Thursday and third Monday, in the Library. Meetings are open to the public. Contact Claudine Perrault at cperrault@estesvalleylibrary.org. 11) Rooftop Rodeo Committee The Rooftop Rodeo is "organized and supported by a committee of dedicated volunteers who contribute their time and talent to host a top -rated show." Membership is open to anyone age eighteen or over who resides within the Park R3 9 School District, with up to eight active membership positions available for non- residents of the District. Membership roles include Active, Associate, Intern and Honorary. Junior Rodeo Committee membership is available for those under the age of 18. Active members comprise the main governing body of the Rooftop Rodeo. Each Active Member is expected to attend at least seven meetings and work on two standing or special sub -committees per year. An Active Member will have one vote on matters which come before the Rooftop Rodeo Committee. Meetings are held every third Thursday at 7 p.m. at the Estes Park Museum. Estes Park Senior Center Division The Senior Center's mission is "to involve and inform Estes Park area seniors and enrich their lives by providing a comprehensive range of programs and opportunities." 1) Estes Park Senior Citizens Center, Inc. Estes Park Senior Citizens Center, Inc. is a non-profit organization with a mission to work cooperatively with the Town of Estes Park to meet the needs of area seniors. 10 The organization meets monthly. Visitor Services Division Visitor Services provides visitors and residents with information about current events, lodging, restaurants, museums, tours, businesses and activities. 1) Estes Park Ambassadors The mission of the Estes Park Ambassadors is "to provide a warm welcome, plus accurate and current information, to the visitors who come to the Estes Valley. We 11 want to help our visitors have an enjoyable and memorable time in this beautiful area." Approximately seventy-five volunteer Ambassadors assist at the Visitor Center front desk year-round. Police The Police Department provides police protection and other public safety programs for the Estes Park area and its citizens, and provides assistance to the Larimer County Sheriffs Department, Colorado State Patrol, and Rocky Mountain. Public Works The Public Works "Department is responsible for engineering services, maintenance of Town streets, parks, fleet, and public facilities. 1) Estes Park Beetle Busters Since 2008, the Beetle Busters, a group of volunteers and Town employees, has assisted in the identification of trees with mountain pine beetle infestations located on public property and within public rights of way. They also help Estes Valley property owners by offering free inspections, presentations to homeowner and 12 mm es Valley. 11 to other associations, and educational materials. Usually these committees exist on a temporary basis. Ad -hoc committee appointments follow the same procedures as regular Town Board appointed committees. Request that all remain at the scene until a law enforcement representative releases i must report the accident to his/her supervisor as soon as possible but 'hours. Volunteers should refrain from any discussion of the accident with anyone other than the investigating police officer, appropriate Town officials, representatives of the insurance company designated by the Town, and/or representatives of the volunteer's own insurance company. If towing is required, the driver must contact the volunteer supervisor for prior authorization. Town vehicles may not tow personal vehicles; therefore, a commercial towing business must be contacted and the bill submitted to the volunteer supervisor. 4. Harassment 14 The Town of Estes Park is committed to a workplace free from harassment. Each employee and volunteer has the right to work in a professional atmosphere which promotes equal opportunities and prohibits discriminatory practices, including harassment based upon age, disability, religion, national origin or sex. At the Town, sexual harassment, whether verbal, physical, or environmental, is unacceptable and will not be tolerated. 5. Work Place Violence The Town of Estes Park strives to maintain a work environment free from intimidation, threats, or violent acts. This includes, but is not limited to, intimidating, threatening or hostile behaviors; physical abuse; vandalism; arson; sabotage, use of weapons; bringing weapons into the workplace; or any other act, which in management's opinion, is inappropriate to the workplace. 6. Volunteer Safety Volunteers have a responsibility to understand and follow all Town rules and safety standards; become familiar with afe and proper use of equipment; and operate all equipment in a safe and careful manner Volunteers should contact their supervisors if unfamiliar with how toperform ajob or to use apiece of equipment sar p! Volunteers must report',unsafe 'working conditions to their supervisors immediately. Volunteers should contact their supervisors for the' location of first aid and AED (automatic external defibrillator) stations. Should ali accident occur, the volunteer must immediately report it to his/her supervisor. If medical treatment is needed, the Town of Estes Park has designated the Timberline Medical Center and Family Medical Center as the providers of treatment for all work -related illnesses injuries Any town volunteer that is iritired on the job must seek treatment at one of these locations. In the? event Timberline Medical Center is not open, treatment may be obtained at the.Estes Park Medical Center Emergency Room. Emergency Cases In cases of life -or limb` injuries, volunteers are required to obtain treatment of work -related injuries end illnesses at the Estes Park Medical Center. A physician will be assigned to the case and all paperwor k will be done at the center. The volunteer will receive a pink copy of the medical center form. This is to be turned in to the supervisor, who in turn will submit it to the Human Resource office. 8. No Pain Injury If a volunteer has been injured on the job, even if there is no pain at the immediate time of the accident, it must be reported to the supervisor and a first report of injury report must be filed. This is a protection for the Town and volunteer in the event that an injury could develop into something larger at a future date. It is safer to report an injury and have a claim number assigned, than to wait and possibly jeopardize the volunteer's benefits at a later date. The 15 volunteer's supervisor must submit the first report of injury form to the Human Resource office within twenty four hours. 9. Accidents Involving Others Should a guest or customer be injured during a volunteer shift, the volunteer should follow these guidelines: • Do not leave the victim unattended. ■ Notify the supervisor immediately and medical personnel as needed. ■ Attend to the victim only to the level of current first aid training. ■ Use appropriate precautions (such as gloves rand masks). Electronic Media Access Policy Volunteers authorized to use Town computers must adhere to the Town's Electronic Media Access Policy. Volunteer Application, Selection and Background Checks To insure a safe environment exists for Town volunteers, Town employees and citizens, anyone interested in becoming a Town volunteer is required to undergo an application and selection process.
