Phipps Absent: None DURWARD - OFF-STREET PARKING: The Committee again considered J. A. Durward's request for a refund of. $5,250 in off-street parking fees which was tabled at the October 21, 1976 Committee meeting. In lieu of the off-street parking fees, Dr. Durward proposes to provide parking on lots 47 and 48 of Buenna Vista Terrace. William Yowell, Attorney, appeared representing James Durward. He explained that in addition to the seven parking spaces presently re- quired, Durward would provide 19 more spaces when he enlarges his building. BRADFORD PUBLISHING CO., DENVER RECORD OF PROCEEDINGS Public Works Committee November 18, 1976 Page Two (2) STEINER - COURTYARD - LAW SUIT: The Committee discussed the law suit involving Greg and Ann Steiner which is set for trial on December 6, 1976. In July 1975, the Steiners were informed that the street lights in front of the Courtyard Building were in violation of the Municipal Code and would have to be removed. The Steiners filed a complaint against the Town in September 1975 be- cause they claimed the installation of the lights had been approved bya former Building Inspector. John Phipps suggested settling the matter out -of -court for reasons that (1) the Steiners have a very strong case, (2) the judge's opinion would probably not differ that much from what could be accomplished in an out -of -court settlement, (3) an out -of -court settlement would be considerably less expensive, and (4) the settlement could be worded to avoid setting a precedent. The Committee recommends accepting the Town Attorney's recommendation to settle the case out -of -court. SUNNY ACRES - TOM BLACK - STREET VACATE: Jim Nolan, Attorney representing Tom Black of B-C Homes, submitted a letter of petition to vacate the 15' roadway in Sunny Acres. The road- way begins at the northerly edge of lot 1 in the amended plat of Sunny Acres, and extends southerly through lot 1, lot 6, lot 5, and a portion of lot 3. In exchange for a vacation of this roadway, Mr. Black and B-C Homes will prepare, execute, and record a private roadway easement running over and across lots 1, 6, 5, and 4 which will grant a private easement to the adjacent land owners for access and utility purposes to their property. The Board of Trustees had previously recommended the Town Attorney pre- pare an ordinance to permit the vacating of the roadway at its meeting of September 23, 1975. The Committee recommends the Town Attorney be directed to prepare the ordinance with the following to be accomplished prior to 1st reading of the ordinance: 1) The petition letter, easement, and other appropriate documents be submitted for review and approval by the Town; 2) All property owners involved (and not their representa- tives) shall sign the petition letter; and 3) A statement will be included exempting the Town of its responsibility of maintaining the streetsin Sunny Acres. MOTEL AREA SIGN - ODD LYNGHOLM: Odd Lyngholm requested a wooden -routed "motel area" sign indicating the direction of the Sunset Motel at the intersection of Elkhorn and Moraine Avenues. The Committee recommends the Town staff confer with the State Highway Department and establish an overall policy on motel area signing. CURB CUT - STATHAM - LOT 8, DEVILLE SUBDIVISION: Richard Statham submitted a request for two 20' separated curb cuts from lot 8, DeVille Subdivision onto Woodstock Drive. This lot has a 215-foot frontage along Woodstock Drive. The map submitted did not contain sufficient detail to make a recommendation and, therefore, the Committee tabled the request until further detail is provided. REPORTS: PUBLIC WORKS SHOP RETAINING WALL - Because of Frank Williams' persistence in disputing the legally established west boundary line of the Public Works building site, the Committee recommends sending Mr. Williams a letter of agreement to sign regarding the boundaries. TALLANT PARK REST ROOMS - The rest rooms are completed and in operation. There being no further business, the meeting adjourned.
