HomeMy WebLinkAboutMINUTES Public Works Committee 1977-01-20BRADFORD PUBLISHING CO., DENVER RECORD OF PROCEEDINGS 100 LEAVES Public Works Committee v/January 20, 1977 Committee: Chairman Dannels, Trustees Petrocine and Sutter Attending: Chairman Dannels, Trustees Petrocine and Sutter Also Attending: Town Administrator Hill, Director of Public Works Van Horn Absent: None BUILDING -CODE & INSPECTION WORKSHOP: The Committee authorized Building Inspector Clint Fairchild to attend a Building Code and Inspection workshop held in Omaha, Nebraska the 24th and 25th of February, 1977. PUBLIC WORKS BUILDING RETAINING WALL BOUNDARY DISPUTE: The Committee reconsidered the Public Works Building retaining wall dispute with Frank Williams. Bill Van Horn explained that originally the old fence did extend partially into the Town's property and so Frank Williams assumed that portion was his. During site preparation the fence was removed. Tom Brown, hired by the Town, and Mr. Stewart, hired by Frank Williams, independently surveyed the site and both surveys agreed with the Town's understanding of the boundaries. Des- pite the surveys, Frank Williams thought he owned the land by adverse possession but Attorney John Phipps explained to him that adverse possession does not apply to Municipal property. With the recently surveyed boundary, Mr. Williams still has the same amount of land he originally purchased. Mr. Williams threatens to tear down the wall if it is built any closer than four feet to his property line. The Committee again considered the matter with respect to point of principle and economics and recommends that subject to the Town Attor- ney's approval, the Town forward a letter to Mr. Williams acknowledging his threats and the property line survey conducted by his surveyor, and inform him of the Town's intention to build the wall as close to the line as possible and that legal action will be taken should there be any interference. SUBDIVISION ORDINANCE VIOLATIONS: Public Works Director Van Horn read aloud a letter from Town Attorney Phipps regarding illegal subdivisions of land. The illegal subdivision by Whittaker, he stated, has run over the one year statute of limita- tions for prosecuting in Municipal Court. The Committee recommends the Town strictly enforce the subdivision regulations and that the Public Works Director attend a Realtors meeting to inform them of subdivision requirements and strict enforcement. MOUNTAIN BELL STORAGE - LANDFILL AREA: A request was received from Mountain Bell to rent some land in the landfill area for storing poles, cable reels, and a 40'to 60'trailer for approximately one tear. The land area requested is currently being leased to Larimer County, and therefore, approval would also have to be obtained from the County. The Committee recommends accom- modating Mountain Bell and obtaining a letter of approval from Larimer County and including a hold harmless agreement with Mountain Bell. ANNUAL REQUEST TO THE STATE HIGHWAY COMMISSION: The County forwarded to the Town for its comment a copy of its annual request to the State Highway Commission. The request contains ten BRADFORD PUBLISHING CO., DENVER RECORD OF PROCEEDINGS 100 LEAVES Public Works Committee January 20, 1977 Page Two (2) priorities in which the following pertain to the Estes Park area: Priority #4: Study of south Estes Park bypass from U.S. 36, State 7, to Spur 66. Priority #7: Additional three lane sections of U.S. 36. Priority #8: Continuation of the reconstruction of State Highway No. 7 to Estes Park. The Committee recommends the Town reply favorably to the County recommendations. OFF-STREET PARKING: The Committee discussed acquisition of off-street parking. Currently the total 1977 budget for off-street parking is $50,000, $12,000 of which is the reserve off-street parking fund. The Committee recommends the staff review the proposed Master Plan to determine present and future parking needs and submit a priority list of off-street parking acquisition. REPORTS: A. EAST RIVERSIDE PUBLIC REST ROOMS - Remodeling of the rest rooms is complete except for the installation of the stalls which are expected to arrive in 2 to 3 weeks. A March 1st opening of the rest rooms is expected. There being no further business, the meeting adjourned. Joan -Van Horn, Secretary
