After review it appears that some changes will need to be made to ensure this design is not considered an accessory dwelling unit (ADU). Detached ADUs cannot have bathing and kitchen facilities, but toilets and sinks are OK. Therefore i believe Planning can provide departmental approval of building permit #9682 should the following conditions be met: 1. Amend plans to remove the proposed shower (prior to building permit release); 2. Land Use affidavit signed by the property owner and recorded at the Larimer County Clerk and Recorder prior to final inspection (attached). The purpose of this is to ensure that the unit will not be rented. By removing the shower and providing the affidavit, this should ensure that the space is not considered an ADU, but rather an office/studio, If this were to be considered an ADU then further adjustments would be necessary (e.g. 800 sf limitation), which may require a variance. l hope you find the above comments reasonable. WHAT IS AN ACCESSORY STRUCTURE? An accessory structure is a structure that is detached from the main building.
