OF Notice of Violation Certified Mail: 9407 1 02 0082 9053 4637 56 RE: Estes Park Municipal Code §14.04,040 - Violation International Residential Code §R105 Permits Property: 503 Big Horn Drive Parcel ID: 35243-00-041 The Community Development Department recently became aware of construction and/or grading done on your property without a permit. This unpermitted work includes a drainage system that was installed on your property prior to the construction of your home. Construction work done without a permit is a violation as stated in the Estes Park Municipal Code: §14.04.040 - Violation. (a) It is unlawful l'or any person to violate any of the provision.s of the international Building Code, international 'Existing Building Code and International Residential Code. Pursuant to the International Residential Code: §R105 Pcrrnits R105.1 Required. Any OtiNtlier or owner's authorized agent 1.vho intends to construct, enlarge, alter, repair, move, demolish or change the occupancy of a building or structure, or to erect, install, enlarge, alter,. repair, remove, convert or replace any electrical,. gas, mechanical or plumbing system, the installation of which is regulated by this code, or to cause any such work to be 1.)er-formed, shall first make application to the building official and obtain the required permit. •k L; Ross and Deborah Maxwell Notice of Violation. June 9, 2016 page two Following a site inspection by the Town of Estes Parks Engineering Manager, Kevin Ash, it was determined that a 15" culvert had been installed below the driveway, extending. over the neighbor's property line. This 15" corrugated plastic culvert. was noted on the development plan for the residence as "existing". The Town of Estes Park investigated and found that this work was done without permit, after the property was purchased. The previous property owner has verified that no such work was done before the sale of the lot, This culvert appears to redirect and consolidate storm water runoff on to the neighbor's property, and on down the hillside, causing flooding in properties below. The culvert has inhibited the ability for the storm water to flow in a historical manner, as required. By receipt of this notice, you are afforded a period of fifteen (15) days to remedy this situation. Remedies shall include either the removal of the culvert, restoring. the natural drainage, or the application of a. building permit, with a stamped engineered drainage plan, demonstrating how this culvert will be modified to return the water to a historical flow condition, not directly impacting neighboring properties. Failure to comply with this notice will result in further action which may include a summons to Municipal Court and possible fines. lf you have any questions concerning this issue, please do not hesitate to contact Kevin Ash, at 970-577- 3586, or me at 970-577-3723. This culvert is 18 inches, in diameter and extends 11 feet onto our property., Once it was installed, it caused flooding to the neighbors below us, and when we bought the property in 2006, the Browns asked us to please mitigate the flooding. Turns out the Maxwells told the city the culvert was pre- existing when they bought the property, avoiding trying to get a permit to channel all of the storm water from The entire mountain side into one culvert draining downhill to the Browns below them. Can you verify that you did not install this culvert, and that the property was unimproved when you sold it to the Maxwells? Many thanks. To do so we would have had to create an engineer's drawing and get city approval from the City Engineer,. They should have turned in a drainage plan when they turned in their drawings for a budding perrnit with the City.
