Dear Ross,
The Community Development Department of the Town of Estes Park has received numerous reports
of activityinvolving the manufacturing of your furniture that is disruptive to the neighborhood. Staff
investigated these allegations and determined that violations to the following Estes Valley
Development Codes are applicable:
This chart illustratesthat “Industry –Custom” is allowed only in the CH-Commercial Heavy and I-1
Restricted Industrial zoning districts.

Furniture making is called out in the definition of Industry-Custom in the Estes Valley
Development Code:
CHAPTER 13. DEFINITIONS
§13.2–USE CLASSIFICATIONS/SPECIFIC USE DEFINITIONS AND EXAMPLES
C. 29. Industry.
b.Industry,Custom: Establishments primarily engaged in on-site production
or repair of goods by hand, involving the use of hand tools and small-scale
equipment, including small engine repair, furniture making and restoring,
upholstering, custom care or motorcycle restoring, and other similar uses.
Additionally, home occupations have specificstandards for compatibility with the neighboring
properties. This can be found in the Estes Valley Development Code:
CHAPTER 5. –USE REGULATIONS
§5.2–ACCESSORY USES (INCLUDING HOME OCCUPATIONS) AND ACCESSORY
STRUCTURES
B.2.d.Home Occupations.
(3)Employees:No one other than a resident of the dwelling shall be
employed on site, report to work at the site or pick up supplies or products
on site in the conduct of a home occupation. This prohibition also applies
to independent contractors. Family home day care home occupations are
exempt from this requirement.
(4)Operational:
(h)All home occupations shall comply with the performance standards
prescribed by§7.10of this Code. There shall be no electrical or
mechanical equipment not normally found in a residential structure.
(i)No home occupation shall be allowed that will create noise, dust,
fumes, odors, smoke, glare, vibration, electrical hazards, fire
hazards or the storage of hazardous materials or any other nuisance
to a greater degree than normally experienced in the residential
district in which the permit is granted.

For your reference, the “performance standards prescribed by §7.10 are as follows:
§ 7.10 -OPERATIONAL PERFORMANCE STANDARDS
In addition to any standards required in the underlying zoning districts, all
development shall meet the following performance standards:
A.Noise.All land uses and new development subject to this Code shall comply
with the noise standards found in Larimer County Ordinance 97-03 (adopted
September 22, 1997, and as amended from time to time).
§7.10 References compliance with Larimer County Ordinance 97-03which is attached to
this notice.
In summary, the Community Development Department has determined that the use of furniture
making is not compliant with the codes outlined in a residential zoning district.You are
afforded a period of fifteen (15) days from receipt of this notice to move or discontinue your
furniture making business from the residence at 503 Big Horn Drive.

Failure to comply will result in further enforcement action which will include a Notice of
Violation and possible Summons and Complaint toEstes Park Municipal Court.
