HomeMy WebLinkAboutMINUTES Public Sanitation 1966-09-01RECORD OF PROCEEDINGS Public Sanitation Committee September 1, 1966 Committee: Chairman Swanson; Trustees Grove and Brodie Attending: Chairman Swanson; Trustees Grove and Brodie Also Attending: Town Clerk Hill and Lee Parker The Committee and Mr. Lee Parker discussed at length the liability of the dump in regard to fire -caused from blowing, burning papers. The Clerk was instructed to check with Mr. Charles Hix on the possibility of a liability property damage policy being written with the Town and Mr. Lee Parker as co-insured. The present three-year dump contract now in effect between the Town and Mr. Parker expires December 31, 1966. The Committee recommends to the Board of Trustees that a new contract, a copy of which is attached toaid made a part of these proceedings, be entered into with Mr. Parker at an annual fee of $10,000.00. Mrs. Nina Cullinan complained to the Committee about blowing paper on her property. Mr. Parker stated he has previously hauled several loads of paper from the Cullinan fence. Mr. Parker also stated that if access was granted him to go on the property, he and his crew would clean up the paper in the spring of each year. The Clerk was instructed to write Mrs. Cullinan as to the facts as stated above. There being no further business, the meeting adjourned. SEP 12 1966 TOWN OF ESTES PARK BOARD OF TRUSTEES 4,-/- 4,c( 504 77/ /7' ?re--o/z/2-)i �o d»,gam 4 00 AGREEMENT THIS AGREEMENT, made and entered into this day of March, 1966 by and between the TOWN OF ESTES PARK, COLORADO, hereinafter referred to as Town, and LEE PARKER, hereinafter referred to as Contractor. In consideration of the mutual covenants and agree- ments herein contained, it is agreed as follows: 1. That the term of this agreement shall be from January 1, 1967 to December 31, 1969, unless sooner terminated as herein provided. 2. That the Contractor shall have the exclusive right to haul refuse and garbage to the Town's dump when the same is hauled for hire; subject to the right of all property owners within the corporate limits of the Town, or their tenants, to haul their own refuse and garbage to the Town's dump, provided the same is not hauled for hire; and subject further to the right of those persons, corporations or governmental agencies granted permits by the Town to haul their own refuse and garbage to the Town's dump. 3. That the Town shall pay to the Contractor, for the performance of this agreement by him as herein provided, the sum of Ten Thousand Dollars ($10,000.00) per year, payable in quarterly installments of Two Thousand Five Hundred Dollars ($2,500.00) on the 1st day of each quarter during the term hereof beginning on the 1st day of April, 1967. )4.. That all salvagable materials deposited at the Town's dump shall become the sole property of the Contractor 5. That Contractor shall perform the following acts and furnish the following services: a. Furnish a garbage and refuse collection service to the property owners within the corporate limits of the Town of Estes Park and the immediate area outside the corporate limits. The services shall be furnished for a 12 month period each year, and the Contractor shall collect the fees for his services from the person receiving the same. b. All such services furnished by the Contractor on Elkhorn Avenue shall be completed each day prior to 8:00 A.M. c. Contractor shall not charge more than the following fees for such services. Per barrel or can of garbage or refuse $ .50 Per barrel of ashes 1.00 Special calls and special loads are to be subject to a reasonable quoted price. d. Contractor shall supply and use the following vehicles: 1 - 3/L ton dump truck - covered 2 - 1 ton dump trucks - covered 1 - 12 ton dump truck - covered e. Contractor shall operate and supervise the use of the Town's dump and have the same open and available for use of the public between the hours of 6:00 A.M. and 6:00 P.M. daily, seven days per week during the months the Sanitary Fill method is being used. Contractor shall have a man on duty at the Town's dump during the months of June, July, and August of each year to enforce Town Dump Use permits issued by the Town. f. Contractor agrees to furnish the necessary equipment and operators to maintain the proper sanitary fill method of dump maintenance. All new excavation at the dump shall be done at the expense of the Contractor.• g. All excess dirt shall remain the property of the Town. h. Contractor shall maintain the dump in a neat and orderly manner. -2- 6. That the Town shall not be liable for any damage or injury incurred at the dump to Contractor -owned facilities and employees, and Contractor shall maintain all necessary Workmen's Compensation Insurance on his employees. 7. It is mutually agreed that this agreement may be terminated by either of the parties hereto upon giving to the other party one (1) year's written notice of his or its intention so to do. It is further mutually agreed that all covenants and agreements herein contained shall be binding upon the heirs, executors, administrators, successors and assigns of the respective parties hereto.
