You are of course welcome to submit an open records request to the Town. The form is available at www.estes.org/openrecords. The Town will respond in accordance with the Open Records Act. The Town’s ordinances relating to vacation home rental are valid and constitutional exercises of the Town’s established business regulation, police, and zoning powers. The Town has the authority to regulate various land uses and business activities. These powers have long been recognized in state and federal jurisprudence. The letter I received from you, dated June 16, was addressed to the Town, with attention to the Town Clerk, the Town Board, the Mayor, and the Community Development Director. If, as you say, you have addressed correspondence to the Planning Commission and the Board of Adjustment, please forward that correspondence to me.
