PERSONNEL POLICY MANUAL -AMENDMENTS.
The Committee reviewed the following potential amendments to the
Personnel Policy Manual:
1.Inclusion of Stanley Park Executive Director/General
Manager as Department Supervisor.In accordance with
the Fair Labor Standards Act (FLSA),exempt employees,
except department supervisors,are paid overtime or
compensatory time.Due to the nature of the Stanley
Park operation,the Executive Director works in excess
of 40 hours/week during the summer season;however,this
excess is adjusted during the winter season.In an
effort to conform with the FISA,the Committee recom
mends the Stanley Park Executive Director/General
Manager position be included as a Department Supervisor.
2.Termination.The Committee reviewed Town Attorney
White’s legal opinion dated January 19,1988 pertaining
to a reduction in the number of employees due to
reorganization and/or reduction in force due to economic
or other circumstances.The Committee recommends the
following paragraph be inserted under--N.Disciplinary
Action——4.Termination,Page 10:

Termination may occur as a
result of a reduction in
the number of employees of
the Town of Estes Park due
to reorganization of the
Town and/or reductions in
force due to economic or
other circumstances.
3.Contract Disclaimer.The Personnel Policy Manual is not
intended to create a contract between the Town and any
employee.The Committee reviewed a legal opinion dated
January 12,1988 submitted by Town Attorney White.The
Town’s insurance agent,CIRSA,has requested such a dis
claimer be included in Personnel Policy Manuals.Town
Attorney White provided language and procedures to be
followed.The Committee recommends the paragraphs
listed below be added to the Personnel Policr Manual
after the Table of Contents--the page number will be
“III”:

“This Personnel Policy Manual does
not and is not intended to create a
contract between the Town of Estes

Park and any employee,or to grant
a right to any employee to be
continued in the employment of the
Town Estes Park,or to limit the
right of the Town of Estes Park to
discharge its employees with or
without cause.
This Personnel Policy Manual is
subject to change by the Town of
Estes Park at any time,including
changes to benefits provided and to
personnel practices,and the
changes may apply to then current
as well as future employees.”
The Committee also recommends a receipt be maintained by
the Finance Department indicating receipt of the manual;
said receipt to read as follows:
“I have received a copy of the
Personnel Policy Manual of the Town
of Estes Park,have read it,and
understand its terms.I understand
that the Personnel Policy Manual is
not intended to be a contract
between the Town of Estes Park and
myself,that the Manual can be
changed,at any time,by the Town
of Estes Park,and that those
changes may apply to me.I ac
knowledge the fact that I have had
an opportunity to ask questions
pertaining to the meaning of this
Personnel Policy Manual.
