Town Attorney Greg White reviewed state legislation on Policemen’s
Pension Fund and stated that the 1978 Pension Reform Act was determined
to be unconstitutional by the Supreme Court. The State Legislature
has amended the 1978 Act and now the Town of Estes Park can be exempt
from the State Policemen’s Pension Plan if it chooses because of its
involvement with the Social Security program. The Town may affiliate,
however, and receive state funding but also must then meet the State’s
stipulations regarding an actuarially sound pension fund.
The Town may file a resolution of intent to affiliate with the State
Policemen’s Pension Plan and then the State will conduct an actuarial
study. The Town would have ninety days to decide whether or not to
affiliate with the State program.
Member Elste moved the Policemen’s Pension Board recommend to the
Board of Trustees of the Town of Estes Park that it file a resolution
of intent to affiliate with the State Policemen’s Pension Plan.Member
Tregent seconded the motion and it passed unanimously.
There being no further business, the meeting adjourned.
