ACQUISITION OF ESTES PARK SANITATION DISTRICT BY THE TOWN OF
ESTES PARK - LEGAL REVIEW:
Mr. Byron Graves, Chairman, Estes Park Sanitation District,
advised the Committee the Estes Park Sanitation District Board of
Directors, by a majority vote, approved the District's
willingness to enter into discussions regarding acquisition of
the Sanitation District by the Town. Attorney White discussed
the legal procedures necessary for the acquisition which included
the following:
1. An agreement between the Estes Park Sanitation District
and the Town of Estes Park.
2. Dissolution of the Sanitation District.
3. Finance - Debt service.
4. Current District employees.
5. Transfer of assets.
6. Sewer rates.
The Sanitation District would file a petition in District Court;
the Court would then hold a public hearing; if sufficient cause
is presented, the Court would order a special election. Dis-
cussion followed regarding the (a) interim period; (b) addition
of a contingency to the agreement should the acquisition not be
passed in the election; (c) rate study; (d) billing procedures,
including an additional computer program; and (e) land planning.
The estimated time schedule is 180 days. Stating land planning
and continuity of service as the basic reasons the Town would
consider acquiring the District, the Committee recommends
approval of the acquisition of the Estes Park Sanitation
District, contingent upon approval of the Agreement by the Town
Board, with Staff, including Town Attorney White, preparing a
"draft" Agreement, returning to the Committee for further review.
The Committee also requested Town Attorney White, representing
the Town, attend the June 10, 1985 Estes Park Sanitation District
Board of Directors meeting.
There being no further business, the meeting adjourned.
