DENVER RECORD OF PROCEEDINGS Code and Sanitation Committee April 11, 1983 Attending: Chairman Wood, Trustees Graves and Hix Also Attending: Trustees Dannels, Houston, Wagner, Town Administrator Hill, Public Works Director Widmer, Building Inspector Jones, Larimer County Health - Lisa Bruinsma, Larimer County Public Works Director Smith DAVID McMULLIN - PERTAINING TO HOUSE BILL 1394: Mr. David McMullin appeared before the Committee to expess concern that the Town was not enforcingstate laws relating to the practice of architecture in Estes Park. Mr. McMullen specifically asked who the enforcement agency was for the state laws and whether or not the building inspector needed to conform to House Bill 1394 (the Architect's Employment Act), or if the Uniform Building Code exempted him. In a letter dated October 21, 1982, Attorney Greg White stated that the District Attorney of Larimer County or the Attorney General of Colorado were the enforcement officers for the State Laws and stated that the Uniform Building Code does not require all plans and specifications be prepared and designed by an engineer or architect licensed by the State and the building inspector may waive the submission of plans and specifications if the work applied for is of the nature that such plans and specifications are not necessary to obtain compliance with the Uniform Building Code. Building Inspector Stan Jones stated that he had discussed this matter with Attorney White this date, April 11, 1983, and Attorney White had not changed his legal opinion. The Committee recommends requesting a subsequent legal opinion from Attorney White to answer all the questions addressed by David McMullen. ESTES PARK LANDFILL: Larimer County Public Works Director Rex Smith appeared before the Committee to pursue the options for the Estes Park Landfill. Chairman Wood stated that the Town had met with Eldon Fruendenberg, Trustee of the MacGregor Ranch, to see if they could obtain an easement across the MacGregor Ranch in order to put a landfill in Section 16. Chairman Wood stated that Mr. Fruendenberg and the other two Trustees for the MacGregor Ranch were not agreeable to an easement across this property. Director Smith stated that he would like to write the specifications for an "Expression of Interest" from the private sector regarding a transfer station in Estes Park. He asked if the present landfill location would be available as the site for the transfer station. The Committee stated that Town property would be available for this use. Director Smith stated that he would do the specs for the "Request For Proposals" and suggested that Larimer County and Estes Park jointly evaluate these proposals for the transfer station. The Committee recommends that the Board of Trustees wait until the Request For Proposals for the transfer station are in before making a final decision on whether to pursue a landfill site. The Committee also recommends that Richard Wood and Richard Widmer be the Estes Park representatives to evaluate the transfer station proposals. Director Smith stated that Larimer County would develop the Estes Park Landfill closure criteria and would actually do the landfill closure. The closure plan would be approved by the Colorado Department of Health prior to the construction. He stated that Estes Park would then be responsible to monitor the site.
