HomeMy WebLinkAboutMINUTES Code and Sanitation Committee 1979-02-06BRADFORD PUBLISHING CO., DENVER RECORD OF PROCEEDINGS Code and Sanitation Committee /February 6, 1979 Committee: Attending: Also Attending: Chairman Rumley, Trustees Burgess and Swickard All Mayor Tregent, Town Administrator Hill, Public Works Director Widmer, Building Inspector Jones 1979 CLEAN UP WEEK: The Committee reviewed the results and costs of the 1978 Clean Up Week and recommends that the Town provide free trash bags for the 1979 Clean Up Week on a limited basis except for appointed Clean Up Chairpersons. Clean Up Week is tentatively scheduled for May 6th - 12th. CONSUMER PROTECTION LAWS: The Committee reviewed and discussed a letter dated January 22, 1979 from the Town Attorney stating that the Town has no statutory authority to enact consumer protection laws. The Committee recommends not adopting consumer protection laws based on the attorney's opinion and directed the staff to forward a copy of the letter to Nicky Kane. CURB CUT APPROVAL AND BUILDING PERMIT ISSUANCE: Section 12.20.010 of the Municipal Code does not state clearly whether or not a curb cut request must be approved prior to issuance of a building permit. The Committee recommends that Section 12.20.010 be amended to read as follows: "Until the application for such permit has been approved by the Board, no building permit for construction on the affected property shall be issued." ELECTRICAL CONSTRUCTION REQUIREMENTS: In order to further clarify section 14.20.080 B of the Municipal Code, the Committee recommends it be amended to read as follows: "All buildings or structures in Fire Zones 2 and 3 other than occupancies R-1, R-3, M-1 and M-2 shall be wired in rigid or steel tube conduit or approved metal raceways." GUEST DWELLINGS IN R-RESIDENTIAL ZONING DISTRICT: The Committee discussed at length guest dwelling definitions and requirements in the R-Residential zone and referred the matter to the Planning Commission for its review. LOT AREAS IN NON -CONFORMING R-1 RESIDENTIAL ZONE: As a code clarification, the Committee recommends to the Planning Commission that it add a minimum lot area of 9,000 square feet for a single family dwelling in a non -conforming R-1 Residential Zone. LOT SIZE RESTRICTIONS FOR R-2 USES IN C-2 ZONES: Presently there are no lot size requirements for R-2 uses in C-2 zones yet there are lot size restrictions for R-2 uses in C-2 zoned lots which were platted prior to 1971. The Committee referred this discrepancy to the Planning Commission for its consideration. PARKING REQUIREMENTS FOR COMMERCIAL USES: The Committee recommends to the Planning Commission that Section 17.36.040 of the Municipal Code relating to parking requirements for commercial uses be deleted. (OVER) GUARDRAILS: The Committee recommends that Section 14.12.050 of the Municipal Code relating to guardrail height requirements be deleted because the same requirements are provided for in the 1976 Uniform Building Code which has been subsequently adopted. RESIDENTIAL USES IN C-2 AND C-1 ZONING DISTRICTS: The Committee recommends to the Planning Commission that residential uses be permitted by right rather than by special review in C-1 and C-2 zoning districts. BUILDING PERMIT FEES: It was brought to the attention of the Committee that the Building Code requires the payment of plan checking fees in relation to the issuance of most building permits. This procedure was placed into effect on January 1, 1979. After considerable discussion the Committee took no action on suggestions to change the method of charging building permit fees. This matter will be reviewed again at a later date. Editorial changes in Section 14.12.030 (4) are recommended that will bring the Municipal Code into conformance with the 1976 UBC.
