HomeMy WebLinkAboutMINUTES Code and Sanitation Committee 1973-10-30RECORD OF PROCEEDINGS Code and Sanitation Committee October 30, 1973 Committee: Chairman Sutter; Trustees Burgess and Wagner Attending: Chairman Sutter; Trustee Burgess Also Attending: Town Administrator Hill, Engineer/Planner Van Horn Absent: Trustee Wagner LAND FILL AGREEMENT: Mr. Roger Connett, Vice President of Estes Park Sanitation, Inc., appeared before the Committee and discussed the 1974 land fill agreement. The attached agreement is recommended to the Board of Trustees for their approval. This agreement between the Town and Estes Park Sanitation, Inc., calls for a 5% increase in the total contract amount. The 1973 contract amount is $27,600 plus 5% ($1,380.00) will make the 1974 amount $28,980.00. LONG RANGE PLAN: The Committee discussed the long range plan for solid waste disposal in the Estes Park area. The Town is working with the Larimer County Commissioners in a joint effort to solve the area wide solid waste problem. Larimer County has hired a solid waste engineer (Andy Brisco). Mr. Brisco has started his solid waste study in Estes Park. There being no further business, the meeting adjourned. APPRZ IED f S NOV 12 1973 TWIN OF ESTES PARK BOARD OF TRUSTEES ArkYiw'.f`iiV'h Town Administrator AGREEMENT THIS AGREEMENT, made and entered into this • day of , 197_, by and between the TOWN OF ESTES PARK, COIDRADO, a municipal corporation, hereinafter referred to as Town,. and Estes Park Sanitation, Inc., hereinafter referred to as Contractor,. WITNESSETH: In consideration of the mutual covenants and agreements herein contained, it is agreed as follows: 1. That the term of this agreement shall be from January 1, 1974; ; to;:Decembe.r,;31, 1974;!. 2. That the Contractor shall have the exclusive right to haul refuse and garbage to the Town's land fill when the same Is hauled for hire;. subject to the right of all property owners within the corporate limits of the Town, or.their tenants, to haul their own refuse and garbage to the Town's land fill, provided the same is not hauled for hire; and subject .to the further right of those persons, corporations or governmental.agencies granted permits by the Town to haul their own refuse and garbage to the 'Town's land fill. 3. The Town shall pay to the Contractor, for the performance of this agreement by him as herein provided, the sum of payable in equal quarterly installments of , beginning on the first day of April,'1974, and continuing on the first day of each quarter thereafter until the Contractor is paid in full. The fore- going sums include all charges to be made to the Town by the Contractor for hauling all of the Town's trash from all Town owned trash receptacles during the term hereof. 4. That all salvageable materials deposited at the Town's land <: " fi11 shall become the sole property of the Contractor. 5. That the Contractor shall perform the following acts and furn- ish the following services: a. Furnish a garbage and refuse collection service to the. property. owners within the corporate limits of the Town of Estes Park, and the immediate area outside the corporate limits. The service shall be furnished for a 12 month period each year, and the Contractor shall collect the fees for his services from the persons receiving the same. b. All such services,furnished by the Contractor on Elkhorn Avenue shall be completed each day prior to 8:00 A.M. c. The Contractor shall charge for such services those tariffs as filed by the Contractor with the Colorado Public Utilities Commission. d. The Contractor shall supply and use sufficient covered packer trucks, and such other covered motor vehicles as are necessary to adequately perform this agreement. e. The Contractor shall operate and supervise the use of the Town's land fill and have the same open and available for use by the public seven days per week during the following hours: May, June, July, August and September 6:00 A.M. to 6:00 P.M. October, November, March and April 7:00 A.M. to 5:00 P.M. December, January and February 8:00 A.M. to 4:00 P.M. The land fill shall be closed all day Christmas. The sanitary fill method of trash disposal shall be used at all times during the term hereof. The Contractor shall have a man on duty at the Town's land fill during all hours of land fill operation to supervise the maintenance of the land fill and the disposal of trash therein. 6. The Contractor shall be required to maintain and service the Air Curtain Destructor. All damages to the Air Curtain Destructor or burn pit caused by negligence shall be repaired by the Contractor. The operation • of the Air Curtain Destructor or any other burning .equipment shall be paid for by the Town to the Contractor in addition to the above provided sums. at the rate of $10.00 per hour. 7. The Contractor agrees to furnish the necessary equipment and operators to maintain the proper sanitary fill method of land fill maintenance, except an Air Curtain Destructor or other burning equipment. All new excavation at the land fill shall be done at the expense of the Contractor. 8. The Contractor shall use al] of the cover material available on the site:that can be excavated without blasting. Additional cover material will be furnished by the Town. All excess dirt shall remain the property of the Town. 9. The Contractor shall maintain the land fill in a neat and orderly . manner. 10. The Contractor shall operate the land fill in conformance with the design and plan attached to and made a part of this agreement (Exhibit 1). The Director of Public Works shall interpret the plan:and direct the long range site development. 11. The Contractor,shall only haul trash from those persons, partner✓ ships .or corporations that have obtained a Town Dump Use Permit. 12, The Contractor shall have the authority to close the land fill to all use when in the Contractor's opinion wind conditions are such that , dumping should not be permitted. 13. The Town shall not be liable for any damage or injury incurred at the land fill. to Contractor -owned facilities and employees, and the Contractor shall maintain all necessary Workmen's Compensation Insurance on his employees. The Contractor shall pay all Social Security and Withholding taxes on all employees. It is the intention of the parties hereto that the Contractor shall be an independent Contractor, and that the Contractor and his employees shall not be employees -of the Town. 14. The Contractor shall not assign this agreement without the Towns prior written approval. 15. It is further mutually agreed that all covenants and agreements` herein contained shall be binding upon the heirs, executors, administrators, successors and assigns of the respective parties hereto. 16. All structures erected or used by the Contractor shall first be approved by the Director of Public Works.. 3- IN WITNESS WHEREOF, the parties hereto have set their hands the day and year first above written.
