Mayor Dekker called the meeting to order at 8:00 a.m.
FULL PENSION ELIGIBILITY — LEGAL OPINION.
Town Attorney White prepared a legal opinion dated July 27, 1999 on the following question:
May a volunteer firefighter who has 20 years of service and has reached 50 years of age
receive his pension and still be a member of the department?
Pursuant to Sections 31-30-1122 and 31-30-1132 CRS, Attorney White provided two
options: (1) create an additional category of volunteer firefighter in which members do
not serve as active volunteer firefighters, or (2) the Town Board could pass a resolution
specifying the need for additional volunteer firefighters.
Discussion followed on the optimum number of volunteer firemen needed, new member
application and selection process, and agility testing,
Mayor Dekker suggested the Fire Dept. place an ad recognizing the employers (list all
employers) of the volunteer firemen for their generosity in assisting the Fire Dept. and the entire
community.
Consensus was reached that Fire Chief Dorman and Attorney White meet to discuss and
prepare a Resolution determining that the Fire Dept. is in need of additional volunteer
firefighters, presenting same directly to the Public Safety Committee for their
consideration.
PRE -RETIREMENT DEATH BENEFIT — LEGAL OPINION.
May the Pension Board pay a pre -retirement death benefit and, if so, can that be pro-
rated based on the number of years of service?
Pursuant to Section 31-30-1126 CRS, Attomey White stated that the Board may pay a
pre -retirement death benefit to the surviving spouse of a volunteer firefighter. The
retirement benefit must be pro -rated based on the number of years of service.
Discussion followed on the potential financial impact to the actuarial study, post and pre -
retirement affects, and any retroactive implications.
Consensus was reached for Fire Chief Dorman to obtain a legal opinion on whether or
not benefits would be retroactive. Once the legal opinion has been obtained, this
question would be referred to the Actuarial Consulting Group, Inc. to determine the
actuarial affects, then the Firemen's Pension Board would meet to make a final decision.
There being no further business, Mayor Dekker adjoumed the meeting at 8:45 a.m.
