President Rumley presented the Constitution and Bylaws of the Volunteer Fire Department for adoption. The Bylaws contained all revisions suggested by Town Attorney White. Following is the motion made by Mayor Dannels: Be it resolved by the Estes Park Firemen's Pension Board that the Constitution and Bylaws of the Estes Park Volunteer Fire Department, a copy of which is attached to these minutes, are hereby adopted as they pertain to the eligibility of members of the Estes Park Volunteer Fire Depart- ment for fire pension purposes. Member McCracken seconded the motion and it passed unanimously. 1988 BUDGET: REVIEW. The Board reviewed the proposed budget for 1988. There being no further business, the meeting adjourned. Vickie O'Connor, Secretary ADOPTED BI.IREMEN'S PENSION BOARD THIS 30th DAY EMBER, 1987. CONSTITUTION AND BYLAWS ESTES PARK, COLORADO, VOLUNTEER FIRE DEPARTMENT Revised as of July 24, 1987 ARTICLE I. Name and Object Section 1. The name of this organization shall be the Estes Park Volunteer Fire Department. This Fire Department is organized under the laws of the State of Colorado and the ordinances,rules, and regulations of the Town of Estes Park, Colorado. Section 2. This organization shall be subject to the authority of the Board of Trustees of the Town of Estes Park, and shall have as its object the extinguishing and prevention of fires within the Estes Park area. ARTICLE II. Officers Section 1. The officers of this department shall consist of a Chief, First Assistant Chief, Second Assistant Chief, and Secretary - Treasurer. These officers shall be elected by ballot at the December meeting each year, and shall hold office for one year or until their successors be elected. A majority vote of all votes cast shall be necessary for election to office. The new officers, upon the acceptance and approval of the Town Board of Trustees, shall assume their duties. Section 2. If any of said offices shall become vacant by death, resignation, or otherwise, the same shall be elected at the next regular monthly meeting of the Department and such elected officers shall hold office until the next regular annual meeting in December. Section 3. Duties of the Chief: The chief shall preside at all meetings of the Department. He shall call special meetings whenever he shall deem it necessary, or upon a written request of five (5) members. He shall appoint all committees required by the Bylaws and for the good of the Department. He shall require a proper observance of the Bylaws of the Department. The Chief shall appoint members to a Hearing Committee consisting of five men in good standing from the Department at the beginning of his term of office, and shall notify the membership of this committee appointment at the next regular meeting following his election to office. Two (2) members shall be appointed for one (1) year and the alternate year three (3) members for two (2) years. The Chief shall have .special charge and keeping of all fire equip- ment and other property pertaining to the Department. It shall be the duty of the Chief to give his individual supervision to the personnel and equipment. The Chief along with the Secretary, shall make an annual report to the Town Trustees in December. He must be prepared to make a statement at that time concerning the status of the Department and apparatus, also regarding the number of fires, alarms, amount of damage done, Department finances, etc. He shall be prepared at that time to make such recommendations to the Trustees as shall be for the good of the Department. Section 4. First Assistant Chief's Duties: The First Assistant Chief shall aid the Chief in the discharge of his duties and shall serve in his capacity in case of absence or inability to serve. Section 5. Second Assistant Chief's Duties: The Second Assistant Chief shall aid the Chief and First Assistant Chief in the discharge of their duties and shall serve in the First Assistant Chief's capacity in case of his absence or inability to serve. ••• - 2 - Section 6. Secretaty-Treasurer's Duties: The Secretary - Treasurer will record and maintain the Minutes of the meetings of the Department. He shall keep a record showing the date of admission to the Department, time of service, and date of final discharge o.f each fireman. He shall keep a record of attendance at meetings of the De- partment. He shall issue the required notices of Department meetings, etc. He_will be the custodian of the funds of the Department, and will receive, safeguard, and disburse them in accordance with the provisions of this Constitution. The Secretary -Treasurer will sign all vouchers covering expenditures of Department funds, providing such expenditures have had prior approval of the Department. The Secretary - Treasurer shall have charge of the Books and records of the Department. ARTICLE III. Meetings Section 1. Annual Meeting: The annual meeting for the election of officers shall be held the first Tuesday in December. Section 2. Monthly Meetings: The regular meeting of the Depart- ment shall be held on the first Tuesday of each month. Section 3.. Quorum: Fourteen (14) members in good standing shall constitute a quorum for the transaction of business.' Section 4. Order of Business: (1) Roll Call, (2) Reading of the Minutes, (3) Proposals for Membership, (4) Balloting for Candidates, (5) Reports of Committees, (6) Communications and Bills, (7) Unfinished Business, (8) New Business, (9) Election of Officers, (10) Sick Call, (11) Adjournment. Section 5. Rules: All questions of procedure shall be deter- mined by Roberts Rules of Order. ARTICLE IV. Members Section 1. Number of Members: The total number of active members shall not exceed the number necessary at any one time. Section 2. No candidate for membership shall be personally con- tacted regarding an application for membership in the Estes Park Fire Department until all requirements of this section have been completed, in order to eliminate any embarrassment to the applicant in the event his application is rejected. Application: An application for membership shall be obtained from the Secretary and shall state the applicant's full name, age, occupation, place of residence, and length of time he has resided in the Estes Park area. Two members must sign the completed application and submit it at the next regular meeting. The Secretary will read the application to the members present after which the Chief will appoint an investigating committee of three members in good standing. The investigating committee will make their report at the following meeting and recommend the approval or disapproval of the application. Following this committee report, the Chief shall call for a secret written ballot on the application for membership and six (6) negative votes shall be sufficient to reject the application for membership. An applicant may become an elected member -of the Estes Park Fire Department when he has signed the membership application complying with the provisions of Article IV, Section 5 of the Bylaws. Section 3. Eligiblity: No person shall become a member of the Department who has not attained the age of 21 years nor attained the age of 45 years, and who has not been a resident of the Estes Park area for one (1) year, nor while he is a member of any other fire department or company. All members will be automatically placed upon retired status upon reaching the age of sixty-five (65), if they have completed 20 years of service, which service is eligible for full retirement pension benifits. Section 4. All honorary memberships must be voted upon by the Department at a regular meeting. Any honorary member is not an active member of the department. Section 5. No candidate shall become a member of this Department until he has agreed to abide by all the provisions of these Bylaws and rules and regulations of the Department. Section 6. Duties of Members: It shall be the duty of all members of this Department to hold themselves in readiness at all times subject to fire alarms. All members shall treat with respect and obey the orders and commands of superior officers and exercise extreme care in the execution of their duties. Section 7. The Certified training of the Department shall be carried out by a Training Officer. This officer will be elected by the membership or otherwise be appointed by the Chief, for a period of one (1) year. All certified hours of training will be recorded by the Training Officer. All other hours of training will be at the discretion of the Chief. Certified training hours shall only be those training hours which are certified training hours by the State of Colorado. Only certified training hours shall count as training hours for retirement pension purposes. Section 8. The period of time a member is on furlough, suspension, and/or leave of absence shall not be considered as active service for retirement pension purposes. Section 9. Any member who does not maintain his principal residence within the Estes Park area shall be expelled from the department, if said member has not been granted a furlough. ARTICLE V. Section 1. Roll Call: The roll shall be called at the opening of each meeting. Section 2. Non -Attendance: Any member absenting himself from three (3) unexcused consecutive meetings shall be dropped from the rolls of the Department unless the members vote to retain his member - shin. A vote of the Department is necessary for reinstatement. Any fireman who shall absent himself from fire calls and only attends meet- ings shall be considered for suspension. ARTICLE VI. Section 1. Furloughs may be granted to members who are leaving the jurisdiction of this Department and planning to return. Said furloughs are to be granted for a period not to exceed one (1) year. Members requesting said furlough must submit a request for furlough in writing to the Department and return to the Department all Department - owned equipment in his possession. Section 2. A member who has served on the Department and left in good standing must submit a notice to the Department of his avail- ability for duty within thirty (30) days of his return to the juris- diction of this Department. Section 3. .Expulsion: The Board of Trustees of the Town of Estes Park may remove the Chief and his assistants at any time for just cause. The Department shall have power to expel any member for conduct un- becoming a fireman. Section 4. Suspension: Any member of the Department may be sus- pended for misconduct for a period of not less than thirty (30) days - 4 - and not to exceed ninety (90) days by the Board of Trustees, Chief, or Assistant Chief, if in their judgment a member's conduct in going to a fire in his private vehicle or Department -owned equipment should be done without regard for public safety and health or in violation of Town or State laws or statutes. If a member should operate a Department -owned piece of equipment while intoxicated, he shall be subject to a misconduct suspension. If a member should operate his own vehicle in a reckless manner and such action endangers the public safety and health, he shall be subject to a misconduct suspension. If a member should by his actions at a fire appear to be unable to perform his normal duties because of illness, intoxication, or injury, he shall cease his actions, retire to a non -action position voluntarily or upon an order from the Senior officer present at the call, or be subject to a misconduct suspension. A member with a second misconduct suspension shall be subject to expulsion from the Department. Section 5. Leave of Absence: A member may request a leave of absence from the Department for a prolonged illness or for any other reasonable request. The Chief shall instruct the Hearing Committee to review each case on its merits. All requests for leave of absence shall be in writing and addresses to the Hearing Committee. If a member desires to return to duty from a leave of absence, the Hearing Committee shall again review the member's request and make their recommendation for granting return to duty. The granting of a leave of absence shall be for a period of up to six (6) months and reviewed at the end of a six-month period by the Hearing Committee, if necessary, and may be extended for another six months, but not to exceed one (1) year for any leave of absence; except, any member who has twenty (20) years of active service and has not reached the age of fifty (50) years shall be granted a leave of absence up to his fiftieth (50) birthday. A member shall retain all rights and benefits attained prior to Leave of Absence as recorded in the Secretary's records. Section 6. Hearing committee: This committee offive men shall review all cases of suspension, misconduct, and expulsion, as well as a member request for a leave of absence, and make a final decision. Any member subject to an action by the Hearing Committee shall be given notice of the Committee Hearing and have an opportunity to present his case before the committee. Section 7. All resignations shall be in writing and submitted to the Department for action at its next meeting. ARTICLE Section 1. Finances: The Department is authorized to accept donations in the form of money orothervaluable considerations from. any legitimate source they so desire. ARTICLE VIII. Section 1. Amendment: These Bylaws may be repealed, altered, or amended at a regular monthly meeting of the Department by a two-thirds vote of the members present. The Proposal to alter or amend shall have been submitted at a regular meeting at least one month previous to the taking of such vote and provided that each member shall have had notice of the proposed amendment or other change.
