APPLICATIONS FOR PENSION:
STEELE, Marvin - Pursuant to the Board's recommendation dated
October 27, 1986, Town Attorney White submitted a legal opinion
concerning Mr. Steele's application for pension. Discussion
followed regarding adoption by the Firemen's Pension Board of a
Constitution and By-laws and pension eligibility requirements.
Member Watson moved (1) Marvin Steele be entitled to a pro -rated
pension of 90% based on 18 completed years of service, with the
effective date to be January, 1987; (2) Town Attorney White
prepare and submit proposed rules and regulations for adoption by
the Firemen's Pension Board; and (3) Town Attorney White research
the question if a member must be classified as "active" at the
time he submits his application for pension. Mayor Dannels
seconded the motion and it passed unanimously.
DIKE, Robert - Mr. Dike submitted his application for pension
following 18 years of service (entered December 3, 1986). Mr.
Dike's pension will be pro -rated at 90% and will take effect
January, 1987. Member Watson moved the application be approved.
Member McCracken seconded the motion and it passed unanimously.
ANNUITY TO A SURVIVING SPOUSE - REVIEW OF LEGAL OPINION:
As directed by the Board October 27, 1986, Town Attorney White
submitted a legal opinion concerning an annuity to a surviving
spouse. Statute and Section 31-30-415 (10), C.R.S. 1973 provides
that the Board may grant such annuity not to exceed fifty (50%)
of the current pension payment for retired volunteer firemen.
The payment is made at the discretion of the Board and is not
required; however, such payments must be uniformly applied to
all. Following discussion, President Rumley advised this matter
will be discussed among the Department; Town staff advised they
will research their records to determine the actual number of
surviving spouses and how this benefit could impact the pension
fund.
There being no further business, the meeting adjourned.
