HomeMy WebLinkAboutMINUTES Public Works Committee 1974-06-27flN RECORD OF PROCEEDINGS Public Works Committee June 27,1974 Committee:Chairman Dannels;Trustees Petrocine and Prosser Attending:Chairman Dannels;Trustees Petrocine and Prosser Also Attending:Town Administrator Hill,Director of Public Works Van Horn,Administrative Intern Julie Burch Absent:None TOURIST INFORMATION CENTER: Mr.Ron Reiland,Manager of the Estes Park Chamber of Commerce,appeared before the Committee in support of a letter dated June 10,1974,(Attached)regarding various questions concerning the proposed tourist information center.The Committee makes the following recommendations to the Board of Trustees: 1)The Town will not require the Chamber of Commerce to install electric heating; 2)The Town will require the Chamber of Commerce to pay all utilities; 3)The Chamber of Commerce reports they now have $32,000 in cash and pledges.The Town shall require the Chamber of Commerce to have 100%of the funds in hand prior to construction. Pledges of money shall be figured at 90%.Pledges of work shall be submitted to the Town in writing,and a dollar worth shall be included; 4)The Town shall not decide as to the general contractor;this decision shall remain with the Chamber of Commerce; 5)The Town Engineer will locate the building on the property for the Chamber of Commerce. DRIFTWOOD AVENUE -STREET OILING: Mr.Seymour Graham appeared before the Committee to request the Town pave an additional 300 feet of Driftwood Avenue South of the existing oiled street. The Director of Public Works reported this portion of Driftwood Avenue has a grade between 12%and 15%.He also reported,in his judgment,the street at the existing grade could not be maintained as to snow plowing in a safe manner. An opinion from the Town Attorney dated June 20,1974,(attached)advises the Town that only by petition of the abutting property owners can the Town make such improvements,and then at the property owners expense.The opinion also stated that the maximum grade established by the Town of Estes Park of 10%may be retained if construction is required.The Committee recommends this request for the oiling of a portion of Driftwood Avenue not be granted because of the grade and safety problems involved. FALL RIVER ROAD: The petition submitted by Frank Williams in regards to Town maintenance of Fall River Road was tabled for the receipt of more complete information. UPPER THOMPSON SANITATION DISTRICT: The request from the Upper Thompson Sanitation District to make changes in the lease for office space in the Municipal Building was rejected by the Committee, and the Town Administrator was instructed to notify Mr.Fred Carpenter of this action. fl RECORD OF PROCEEDINGS Public Works Committee June 27,1974 Page Two (2) SIGNS: Metal Street Signs:The Director of Public Works reported to the Committee the extreme difficulty in obtaining metal street signs.The excessive cost of purchasing a machine to do this work ($2,500.00)indicates the Town should make some other arrangements.The Director of Public Works will attempt to work out a joint use agreement for the production of metal street signs with either the National Park Service,Larimer County or the City of Loveland. Routed Wooden Street Signs:The Director of Public Works submitted a sample routed wooden street sign to the Committee.The Street Department can purchase a router ($200.00)and produce these signs at an estimated cost of $6.00 —$8.00 each.The Committee recommends immediate approval and implementation. PROGRESS REPORTS: 1)The landscaping in front of the Municipal Building will not begin prior to July 15th because of delivery problems with the sprinkler system.The islands in the back or East side of the Municipal Building will be completely landscaped by July 1st.The construction on the new curbing in front of parking lot #1 will begin on July 3rd. 2)The availability of sign letters has delayed the permanent sign to be placed on the Fire and Police Building.This matter is being pursued through the company furnishing the letters. 3)Construction on the sidewalk,curb and gutter for Bond Park will begin July 1st.The superintendent advises the sprinkler system will not be available prior to July 15th. 4)The Street oiling program is in progress.The streets to be over—layed have been completed.The new street seal and chip work has not yet begun. 5)The interior islands on the Post Office and Dark Horse parking lots will be landscaped with material not requiring irrigation.Completion of this project will be sometime during the summer of 1974. The landscaping of the exterior or river area of this parking lot are still under design and a further report will be submitted to the Committee at their next meeting for their approval. 6)The planter in front of the Municipal Building has now been completed. TRAFFIC ISLANDS: The small traffic island at the intersection of Highways No.36 and 7 will be sterilized toe-liminate weeds and additional rock added as needed. The large islands at this intersection will be developed by adding several focal areas of rock and low plantings.The natural grasses now planted in this area will be maintained. 00 RECORD OF PROCEEDINGS Public Works Committee June 27,1974 Page Three (3) KENNETh KING REQUEST: Mr.Kenneth King submitted a request for the Town to pave the entire street right—of—way of Big Horn Drive near the entrance to his property.(sketch attached)As recommended by the Director of Public Works,the Committee inturn recommended to the Board of Trustees that Mr.King be instructed to proceed with his driveway paving and tie it in with the existitg oiled street and that the Town will not extend the road surface at this time. RUBBER TIRED LOADER: Director of Public Works submitted the following bids for a rubber tired loader: COMPANY GROSS TRADE NET Caterpillar 39,270 6,470 32,800 John Deere 35,000 12,000 23,000 The Committee recommends the Director of Public Works be authorized to accept the bid as submitted by John Deere with trade in the amount of $23,000.00, and that this purchase shall be funded out of Federal Revenue Sharing. WEIST PARKING LOT: The Director of Public Works submitted a plan to add 12 parking spaces to the West end of Weist parking lot.The estimated cost of this addition will be $600.00 for the excavation.The surfacing of this portion of the Weist Lot will be considered at a later date.The Committee recommends this project be approved and that construction be scheduled for the fall of 1974. DRIVE WAY EDGES: The Committee recommends that the drive way edges in the downtown area be painted yellow to a standard to be determined by the Director of Public Works. This painting will be done only on the request of the property owner. LIBRARY FURNITURE: The Library Board has submitted a list of furniture needed to expand all library furniture into the area formerly used as a meeting room.This request is detailed in a’letter dated May 22,1974.(attached)The total cost of this project is $2,327.24.The Committee recommends approval of this request. There are several points our board would like to clarify regarding construction of the center and it would appear best to do this in a meeting with our committee and the town. Through the course of this meeting we would like to clarify the following: 1.At what point in our fund raising efforts can we consider sufficient monies have been collected to begin construction. 2.How are we to handle the construction.Would the Chamber act s its own genral contractor?How would we treat contributions of labor,excavation etc.? 3.Should electric heat be installed in the building to follow the trend in municipal buildings,or may we consider natural gas? 4.Due to the towns anticipation of an increase in electricity, if this is desired by the town,is there any possibility of the town supplying electric service for the building? 5.Can the city engineer adequately survey the proposed location so as to assure a contractors properly locating the building structure? I would appreciate your setting up a meeting,at the convenience of the public works committee,and notifying me of same. Thank you for your consideration. The Town cannot be required to open any street until it has first accepted the dedication of that street.The Plat of Country Club Manor Addition shows that the Town did accept the dedication of those streets shown thereon on May 23,1938. Whenever the owners of a majority of the frontage of the lots or lands adjacent to or abutting upon any street or designated portion thereof shall petition the board of trustees in writing to grade or gravel or otherwise surface said street or designated portion thereof,it shall be the duty of the board of trustees to order said improvement and assess the cost against the lots or lands adjacent to or abutting said street so improved.Section 139-78-4,Coloraco Revised Statutes 1963,as amended. The Town may cut the natural surface of the land to a legally established grade as set by ordinance without being liable to the owners of abutting lots for the consequential damages to said lot owners’property caused by said cutting. This is true as long as the Town does this cutting of the natural surface in a reasonable and careful manner.Section 16.16.080 of the Estes Park Municipal Code establishes a maximum grade of 10%for local streets.The Town can cut the natural surface of the street down to a grade of 10% without having to compensate the owners of the abutting prop erty for any damage causby the construction of said street in such a manner,as long as such construction is done in a reamenabi•an6 cai.fu1 mannQr. Mr.William Van Horn June 20,1974 Page 2 In summary,the Town has accepted the dedication of Driftwood Avenue as shown on the Plat of May 23,1938. The Town must improve the street if the owner or owners of a majority of the frontage of the lots abutting the portion of the street to be improved petition the Town for such improvement.However,the Town can assess the cost of the improvement to the abutting property.The Town can cut the natural surface of land down to the 10% grade established by Section 16.16.080 of the Code without being liable for damage to the abutting property if this cutting of the natural surface is done in a reasonable and careful manner.
