We are submitting the following proposal before we are re quired to set up a number of depositions and avail ourselves of the various discovery means enumerated in the Rules of Civil Procedure. The following is a brief summary of our proposal which can be amplified by the presentation of more details,includ ing a topographical map and other plats at the meeting of the Public Works Committee on January 16,1975,at 3:00 o’clock p.m.: (1)Mr.Williams will convey the ten acres of land bordering approximately 700 feet of the disputed road and with a river frontage of approximately 300 feet.It is a choice and ideal piece of land to fit into the Town’s “green belt”plans.It has estab lished hiking trails which would lend further attrac tion to the area as a green belt. (2)As I understand the situation,the Town has federal funds available for the purchase of such land, and,furthermore,the land could be used for such n ‘ JOSEPH P.JENKINS,P.C. (3)In return,Mr.Williams would ask that the Town assume the deed of trust on the property to the use of Barney Shewfelt with a present balance of $58,575.00 payable in five equal annual in stallments of $11,715.00,plus interest at the rate of 7—1/2%per annum.It is my understanding that the value of the land far exceeds the balance due,and we hope to verify this by presenting the appraisal of a local real estate agent to the Com mittee. (4)Also in return,Mr.Williams would ask the Town to convey to him a tract of land of approxi mately one and a half acres located on Spur 66 west of the Landf ill Road,which is of no particu lar use to the Town at the present time. (5)In consideration of such mutual conveyances, the Town would agree to incorporate the disputed road in the Town street system,and that appro priate action be taken to dismiss the pending law suit.The technical aspects of dismissal and an appropriate judgment can be worked out by the at torneys.It would seem that the abutting land owners would have no objections since they will profit from the green belt zone. There are many -advantages to-the Town besides the--saving of litigation expenses.Furthermore,the outcome of the law suit could well be adverse to the Town,and is a possibility which must be considered. I am advised that the Upper Thompson Sanitation District sewer line will be located at a point approximately 115 feet west of the river,and that all other utilities are readily available. flITh JOSEPH P.JENKINS,P.C. Page 3 Hartwell &Babcock 1/9/7 5 There are other considerations which can be discussed at the meeting,and we will be available for questions.It would appear that since the Town is serious in its efforts to create green belts,and federal funds are available for such purposes,an in—depth consideration should be given by the Town to these proposals. I have taken ‘the liberty of sending four copies of this letter to Dale Hill so that they can be distributed to the Committee members in advance of the meeting.We will have the other material available at the meeting of January 16, and sooner if a request is made for same.
