Water Applications:
Colorado State College:(Old Man Mountain Ranger Station)
This application for water was
rejected because of the elevation.
James Johnson:Beaver Point.Application for two
units.Tap beer (1 unit)and Walk
Up Restaurant (1 unit).Because of
units removed in 1955,the regular
out—of—town connect fees will be
waved.The Water Comndttee stated
this auplication will not be renewed
again.This concession will clear the
Department of all obligations in regard
to connect fees.This application
will be subject to the new out—of—town
water agreement.
C.H.Hoper and Co.:
In a letter dated Jan.31,1961,Mr.Hoper informed the
Committee he has not finished the ratsurvey.In regard
to the rate survey,the Comirittee instructed Dale Hill to
proceed with the hose bib survey of the water system.
Out—of—town Water Agreement:
The proposed out—of—town agreement was read to the Committee.
The Water Committee recommends to the Board of Trustees the
adoption of the above agreement.A copy of this agreement is
attached to the minutes of this meeting.
Big Thompson Plant:
Supt.McCracken requested permission from the Committee to have
the weir in the clarifier rebuilt at an estimated cost of
l,5OO.OO.The Water Committee approved the request.

AGREEMENT
THIS AGREEMENT made and entered into this

party of the first part,and ——

party of the second part,WTTNFSSEI’H:
WHEREAS,the rty of the second part has made application to the
Water Department of the Town of Estes Park for a tap to the first partyts
water system or for the extension of water service to serve new or additional
facilities,owned by the party of the second part,and the first oarty
having no objection to the permitting of said tap but desires to establish
in writing certain limitations concerning service and certain agreements
pertaining to the conditions under which said tap is to be granted and
under which the water service may be continued.The legal description of
the property to be served is as follows:

NOW THEREFOEE IT IS MUTUAlLY AGREED AS follows:
1.The party of the second part agrees to pay the present existing
tap fees as nrovided by said Water Department and does further agree to
comply with the rules and regulations of said Water Department as such
rules may affect all out—of—town water use and whether such rules are
now in effect or may hereafter be adopted by said Water Department or
the party of the first part.
2.The seccnd party further agrees that the water service provided
for herein shall not be extended to serve any improvements or use other
than as herein set forth.

3.It is further particularly understood and agreed that the
first party is permitting said water tap as an accommodation to the
party of the second part,and because of present demands upon the Town’s
water supply,the second party specifically agrees that the first party
shall have no liability or responsibility concerning adequate service or
pressure in the water pipe lines which the second party shall tap for
its service.
4.The first party reserves the right to discontinue water
service if,in the discretion of the Water Superintendent of the first
party,the water supply and service lines pressure bec9me inadequate to
serve the premises as indicated in the application made by the party of the
second part.
5.This agreement shall extend to and be binding upon the heirs,
administrators,executors and assigns of the party of the second part.
6.The party of the second part agrees and consents to this
instrument being recorded and made a part of the abstract of applicant’s
property.
IN WITNESS ‘IIEREOF,this Agreement is sicned by the party of the
second part and by the party of the first part r its Town Clerk,the
day and year first above written.
