The Water Committee reviewed the Black Canyon pipe line project. After considerable discussion and upon the advice of the Town’s attorney,Mr. Ernest C.Hartwell,and the Town’s water engineer,Mr.Robert Crabtree,the Water Committee recommends to the Board of Trustees the following Resolution be adopted and that it become effective January 1,1965: RESOLUTION BE IT RESOLVED BY TEE BOARD OF TRUSTEES OF THE TOt1N OF ESTES PARK, COLORADO: That the Town of Estes Park shall not furnish water services outside of the corporate limits of the Town until such time as the Board of Trustees shall determine that the Town can furnish adequate water services to the users within the corporate limits;provided,however,that this resolution shall not be applied to water users outside of the corporate limits now receiving water service. IT IS FURTHER RESOLVED,That the foregoing resolution shall not be applied to those properties to which the Town is obligated to furnish water service to in accordance with the terms of certain written agreements between the Town and Pieter Hondius and Eleanor Hondius dated January 22,1951,John W.Ramey dated March 28,1960,and a deed to the Town from Julian Hayden and Louise Reed Hayden recorded in Book 1007,at page 170 of the records in the office of the Clerk and Recorder of Larimer County,Colorado;provided, however,that water service to such properties shall be limited to the Town’s ability to furnish such service as determined by the Water Committee of the Board of Trustees. WATER DEPARTMENT RULE Rural Subdivisions In accordance with the resolution adopted this date,the Water Committee recommends not more than three units be permitted to connect to the Town’s water system in any one calendar year in any rural subdivision covered in the above-mentioned resolution. Water Superintendent McCracken informed the Committee the Ebner right-of-way agreement was now complete with the exception of the proper legal description. Town Engineer Van Horn will obtain the legal description.
