Absent:Trustee Swanson Water Applications: The Committee approved an application for a single family residence for Mr.Leonard A.Murphy,Valhalla Cottages west of Estes Park. The Water Rights fee shall be based on one (1)acre of ground. Mr.and Mrs.John R.Powell requested the Committee reconsider their ruling that the Water Rights fee for Lot 8,Stanley Heights Addition “A”be based on the total three acre site.The Committee recommends their decision not be changed and that the Water Rights fee be charged for the entire amount of area (3 acres). The Committee reviewed Mr.C.H.Hoper’s recommendation that a connect fee not be charged for taps on the water system when they are for fire protection only.The Committee agreed with this suggestion and recommends the fees charged for fire protection taps be limited to actual costs. C.H.Hoper and Associates have recommended the Town adopt rules and regulations pertaining to the connection of private fire protection facilities to the water distribution system of the Town of Estes Park. A copy of these rules and regulations i s attached to and made a part of these proceedings.The Committee recommends these rules and regulations be forwarded to the Town Attorney for the purpose of placing them in the form of an ordinance. Mr.Clarence A.Graves,the Town of Estes Park representative to the Six City Water Association,will report to the Water Committee on March 3,1969. The Committee discussed at length the rising costs of raw water.The Committee recommends a resolution and an ordinance be submitted to the Board of Trustees in relation to the future purchases of water.Copies of the above mentioned resolution and ordinance are attached to these minutes. Superintendent McCracken informed the Committee he feels there is a need for a larger water main in the area of the Elkhorn Lodge. Superintendent McCracken will review this need with the consulting engineers,Phillips,Carter Reister and will also submit estimated costs of this project. C I —%_n_______._t ORDINANCE NO AN ORDINANCE ANENDING SECTION 6.6 OF THE MuNICIPAL CODE OF TEE TOWN OF ESTES PARK,COLORADO,THE SANE PERTAINING TO TAPPING CHARGE SPECIAL FE$. BE IT ORDAINED BY THE BOARD OF USTEES OF TEE TOWN OF ESTES PARK,COLORADO: Section 1.That the second paragraph of Section 6.6 of the Municipal Code of the Town of Estes Park, Colorado be and the same is hereby amended by striking the figures $23L,37 and inserting in lieu thereof the figures $250.00;and by striking the figures $117.18 and inserting in lieu thereof the figures $125.00. Section 2.The Board of Trustees herewith finds,determines and designates that this ordinance is necessary for the irnediate preservation of the public health and safety for the maintaining of water tapping charges and fees affects the public health and safety,and whereas in the opinion of the Board of Trustees an emergency exists,this ordinance shall take effect and be in force five (5)days after its final passage adoption and publication. V V Mayor ATTEST: Town 1e±k V V F% BE IT RESOLVED BY THE BOARD OF TRUSTEES OF THE TOWN OF ESTES PARK,COLORADO: That for the purpose of determining the anount of water or the money equivalent thereof to be furnished to the Town in compliance with Section 21.9—5 of the Municipal Code of the Town of Estes Park,Colorado, one unit of Northern Colorado Water Conservancy District water (sometimes referred to as one acre foot of Northern Colorado Water Conservancy District water)shall be equal to .80 of an acre foot of water.The money equivalent of one unit of Northern Colorado Water Conservancy District water shall be established by the Board of Trustees at its next meeting following the filing of each annexation petition with the Town Clerk.All resolutions in conflict herewith are hereby repealed. 0.H.HOPER A )CIATES Page One January 29,1 RULES AND REGULATIONS PERTAINING TO CONNECTION OF PRIVATE FIRE PROTECTION FACiLITIES TO THE WATER DISTRIBUTION SYSTEM OF THE TOWN OF ESTES PARK Application Form Before any separate connection shall be made for automatic sprinkler systems for fire protection (hereinafter called “sprinkler systems”)to the water distribution system of the Town of Estes Park,an apptication shall be made therefc contaming detailed plans and specificatiobs for the facilities to be installed and the location of same.Said application shall contain a written agreement with the Town that the applicant agrees to the following rules and regulations pertaining to such service. Rules and Reutations 1.The installation of a sprinkler system shall fully meet the latest standards of National Fire Protection Association relating to the installation of sprinkler systems.The installation shall also meet the approval of the Fire Department an of the Water Department of the Town of Estes Park before final connection may be rmde. 2.The proposed sprinkler system shall be properly protected against freezing. 3.The separate connection made to the water distribution system of the Town shall include,in addition to the installation of a satisfactory shut-off valve,two check valves installed in series on the downstream side of the gate valve to preve any backflow into the Town’s distribution system.The Town may require the / C.H.HOPER &fATES Page Two January 29,19E instaUation of a detector check valve by-pas meter device as approved by the Town.Said device shall be installed as directed bythe Town. Where any anti-freeze solution is to be used,a backflow and back-siphonage preventer device,as approved by the Town,shall be installed in lieu of the two check valves in the water connection.Anti-freeze solutions shall be made only of pure water and pure glycerin (C.P.or U,S.P.96.5%Grade)or propylene glycot. Other solutions are considered possible health hazards and their use is prohibited. 4.Applicant shalt pay all costs incurred in tapping the Town’s water main and in making the connection,all in accordance with these rules and regulations and under the supervision of the Water Department of the Town. 5.The sprinkler system installed shall be of the enclosed type so arranged that no water can be drawn off excepting through a sprinkler head.Applicant agrees that nothing shalt be connected to the sprinkler system other than facilities required for fire prevention uses necessary for extinguishing fires and that no use of water shall be made for any other purposes whatsoever excepting for testing as herein after provided. 6.Any use of water through the connection for the sprinkler system for other than testing or for the extinguishment of fires shall be cause for the Town disconnecting the sprinkler system from its water distribution system and applicant shall be liable for water diverted in accordance with the water rateschedules of the Town with consumption and period of time involved.estimated by the Town. 7.Applicant shall notify the Town in advance of any tests to be made and the opportiknity shalt be afforded for the Town’s representatives to attend any such tests. C I a 4 I—’ C.H.HOPER ,As DIATES Page Three January 29,) 8.Excepting in case of fire where an alarm has been received by the Town’s Fire Department or tests of which the Town has been notified in advance,applicant shall promptly notify the Town of any operation of the sprinkler system for any purposes whatsoever. 9.Any changes,including expansion of the sprinkler system as described in the original application,shall necessitate a new and revised application. 10.The Town of Estes Park assumes no responsibility or liability in connection with the operation of the sprinkler system and the Town in nowise warrants or guarantees water pressure to actuate the system installed. 11.There shall be an annual charge of $25.00 paid in advance by applicant to the Town while the sprinkler system is connected to the Town’s distribution system. This charge is considered required to periodically inspect the facilities installed. 12.Where the term “applicant”is used in these Rules and Regulations,it is intended to designate the original applicant or his successors and assigns. —I ‘-3
