Home My WebLink AboutBYLAWS Estes Park Board of AdjustmentESTESPARKBOARDOFADJUSTMENTBYLAWS[ADOPTED01/2022]I.ROLETheEstesParkBoardofAdjustment(EPBOA)isestablishedundersection2.1(D)oftheEstesParkDevelopmentCode.TheEPBOAexercisestheauthoritygiventoitbytheTownBoardasoutlinedbelow:1.PerIormallofthedutiesandresponsibilitiesofamunicipalboardofadjustmentpursuanttoColoradolaw;and2.PerFormallofthedutiesandresponsibilitiesoftheEPBOAasdescribedintheEstesParkDevelopmentCode.“Chair”intheremainderofthisdocumentwillrefertotheChairofEPBOA.II.MEETINGSA.RegularMeetings.ShallbeheldthefirstTuesdayofeachmonth,withadditionalmeetingsscheduledasneeded.Regularmeetingsshalloccurat9:00a.m.Anyitemontheagendawhichcannotbeheardandconsideredbytheconclusionofthemeetingmaybecontinueduntilandheardatthenextregularlyscheduledmeetingoraspeciallyscheduledmeetingandshallhavepriorityoveranyothermatterstobeheardandconsidered.B.SpecialMeetings.MaybeheldatanytimeuponcallbytheChairortheCommunityDevelopmentDirector.Noticeofatleastthree(3)calendardaysshallbegiventoeachmemberoftheEPBOA.Thetime,place,andpurposeofthespecialmeetingshallbespecifiedinthenoticetotheEPBOAmembers.Shouldaspecialmeetingbescheduled,notificationmustbeprovidedtotheEPBOASecretaryinanefforttoadequatelynotifythepublicinaccordancewiththeStateofColoradoOpenMeetingsLawSection24-6-402(2)(c)C.R.S.C.CancellationofMeetings.RegularlyscheduledmeetingsoftheEPBOAmaybecancelledorrescheduledupondeterminationbytheChair.AnycancelledmeetingrequiresnotificationtotheCommunityDevelopmentDirectorinanefforttoadequatelynotifythepublic.D.MeetingProcedures.Chairshallpresideinaccordancewithgenerallyacceptednormsfortheconductofparliamentaryprocedure.TheEPBOAmayoverturnaparliamentarydeterminationoftheChairbymajorityvote.Robert’sRulesofOrdermaybeconsideredasaparliamentaryguide. E.OpenMeetings.AllmeetingsandactionoftheEPBOAshallbeinfullcompliancewithstatestatutesgoverningopenmeetings,asamendedandincorporatedhereinbyreference.ItistheresponsibilityoftheassignedstaffmemberofCommunityDevelopmenttobefamiliarwiththesestatutesandregulations.F.AttendancebyNon-members.MeetingsmaybeattendedbypersonswhoarenotmembersoftheEPBOA.AtthediscretionoftheChair,non-membersmaybeallowedtospeakatmeetings.However,innoeventshallnon-membersbeallowedtovoteonmattersforwhichavoteisrequired.III.MEMBERSANDQUORUMA.Membership.TheBoardconsistsofthree(3)votingmembers,asprovidedintheEstesParkDevelopmentCode.AppointmentsofmembersshallbemadebytheTownBoardinaccordancewithPolicy102.B.Terms.Membersshallbeappointedtoathree(3)yearterm.Thetermsofthemembersshallbestaggeredsothatthetermsofanequalnumberofthemembers,orasequalanumberaspossible,expireonthelastdayofMarcheachyear.Therearenotermlimitations,andmembersmaybereappointedbytheTownBoardinaccordancewithPolicy102.C.Vacancies.VacantpositionsshallbefilledbyappointmentbytheTownBoardfortheunexpiredportionofthetermofthepositiontobefilled.D.Quorum.AquorumfortransactionofbusinessoftheEPBOAshallconsistoftwo(2)membersoftheEPBOA.Thisistheminimumnumberofmembersrequiredtobepresenttoopenameetingandconductbusiness.E.Action.AnyactionbytheEPBOAshallbebymajorityvoteofthemembersattendinganyregularorspecialmeetingatwhichaquorumispresent,unlessotherwiseprovidedbylaworordinance.Atievoteshallconstitutefailureofthemotiononthefloor.F.TownBoardLiaison.TheTownBoardmayappointoneofitsmembersasaliaisontotheEPBOA,whoshallreceivecopiesofallnotices,documents,andrecordsofproceedingsoftheEPBOAwhichanymemberwouldalsoreceive.IV.OFFICERSA.Officers.ThereshallbeaChairandaViceChairasselectedbytheEPBOA.B.Elections.Officersshallbeelectedbythemembersannually,atthefirstregularlyscheduledmeetinginAprilofeachyear.Officersshallbemembersof theEPBOA.NotificationofwhoiselectedChairandViceChairwillbesenttotheTownClerk.C.ChairResponsibilities:1.Presideatallmeetings2.Ensurethatallmeetingsareconductedwithdecorumandefficiency3.Callspecialmeetingsinaccordancewiththebylaws4.Authoritytocancelameeting5.SignanydocumentspreparedbytheEPBOAforsubmissiontotheTownBoardorTowndepartments6.RepresenttheEPBOAindealingswiththeTownBoardorotherorganizations7.TheChairhasthesamerightasanyothermemberoftheBoardtovoteonmattersbeforetheEPBOA,tomoveorsecondamotion,andtospeakfororagainstproposals.D.Vice-ChairResponsibilities:1.AssisttheChairasrequested2.AcceptandundertakedutiesdelegatedbytheChair3.PresideovermeetingsorperformotherdutiesoftheChairintheeventtheChairisabsentorunabletoact.E.ChairProTern.IntheabsenceoftheChairandVice-Chairatagivenmeeting,theEPBOAmayelectavotingmembertoserveasChairforthedurationofthatmeeting.V.STAFFROLEAnassignedstaffmemberoftheCommunityDevelopmentDepartmentisresponsibleforpropernotificationofmeeting,preparationanddistributionofagenda,assemblyofpacketandminutetakingforallmeetings.VI.ATTENDANCERegularattendancebythemembersoftheEPBOAisexpected.Intheeventanymembermissesthree(3)consecutiveregularmeetingsoratotaloffour(4)regularmeetingsinacalendaryear,theTownBoardmayremoveitsappointedmemberforneglectofdutyanddesignateanewmembertofillthevacancy.VII.GENERALPROVISIONSRecommendationsforamendmentstothesebylawsmaybeadoptedatanyregularorspecialmeetingoftheEPBOAbyamajorityofthemembershipoftheEPBOAprovidedthatnoticeofsuchpossibleamendmentsisgiventoallmembersatleastfive(5)dayspriortothemeetingatwhichactionistobetaken.AnyamendmentsshallbesubjecttoapprovalbytheTownBoard. VIII.COMPLIANCEWITHTOWNPOLICIESA.Inadditiontothesebylaws,theEPBOAshalloperateincompliancewiththeadoptedTownBoardpolicyonTownCommittees,Policy102,asamended.Thetermsofthispolicyareincorporatedintothesebylawsbythisreference.Acopyofthepolicy,alongwiththesebylaws,shallbeprovidedtoeachmemberatthetimeoftheirappointment.B.FailuretocomplywithapplicableTownpoliciesmaybegroundsforanofficialreprimandorcensurebytheEPBOAand/orarecommendationtotheTownBoardforremoval.IX.CONFLICTOFINTERESTAllmembersoftheEPBOAaresubjecttothestandardsofconductundertheStateofColoradoCodeofEthics,Sections24-18-101etseq.,C.R.S.,andArticleXXIXoftheColoradoConstitution(Amendment41).AtthetimeofintroductionofanindividualitemontheEPBOAagendainwhichthememberhasaconflictofinterest,themembershallstatethataconflictofinterestexistsandthenabstainfromparticipatingandvotingonthematter.AmemberhavingaconflictofinterestonanymattershallnotattempttoinfluenceothermembersoftheEPBOAatanytimewithregardtosaidmatter.Adoptedthisof_____________,2022.ESTESPARKBOARDOFTRUSTEES)By:Mayor
