Home My WebLink AboutBYLAWS Estes Park Planning CommissionESTESPARKPLANNINGCOMMISSIONBYLAWS[ADOPTED01/20221I.ROLETheEstesParkPlanningCommission(EPPC)isestablishedundersection2.1(C)oftheEstesParkDevelopmentCode.TheEPPCexercisestheauthoritygiventoitbytheTownBoardasoutlinedbelow:1.PerformallofthedutiesandresponsibilitiesofamunicipalplanningcommissionpursuanttoColoradolaw;and2.PerformallofthedutiesandresponsibilitiesoftheEPPCasdescribedintheEstesParkDevelopmentCode;and3.MakerecommendationstoTownBoardregardingtheTown’sComprehensivePlan,providedthatfinaladoptionoftheComprehensivePlanshallbeatthediscretionoftheTownBoard.“Chair”intheremainderofthisdocumentwillrefertotheChairoftheEPPC.II.MEETINGSA.RegularMeetings.ShallbeheldthethirdTuesdayofeachmonth,withadditionalmeetingsscheduledasneeded.Regularmeetingsshalloccurat1:30p.m.Anyitemontheagendawhichcannotbeheardandconsideredbytheconclusionofthemeetingmaybecontinueduntilandheardatthenextregularlyscheduledmeetingoraspeciallyscheduledmeetingandshallhavepriorityoveranyothermatterstobeheardandconsidered.B.StudySessions.StudysessionsoftheEPPCmaybescheduledbytheChairortheCommunityDevelopmentDirectorasneeded.Suchmeetingsshalloccurat11:00a.m.oranothertimespecifiedbytheChairorCommunityDevelopmentDirector.Noofficialactionshallbetakenandnoquorumshallberequiredforthestudysession.Thestudysessionshallbeopentothepublic.UnlessrequestedbytheChair,nopubliccommentshallbetakeninastudysession.C.SpecialMeetings.MaybeheldatanytimeuponcallbytheEPPC,theChairortheCommunityDevelopmentDirector.Noticeofatleastthree(3)calendardaysshallbegiventoeachmemberoftheEPPC.Thetime,place,andpurposeofthespecialmeetingshallbespecifiedinthenoticetotheCommissioners.Shouldaspecialmeetingbescheduled,notificationmustbeprovidedtotheEPPCSecretaryinanefforttoadequatelynotifythepublicinaccordancewiththeStateofColoradoOpenMeetingsLawSection24-6-402(2)(c)C.R.S. D.CancellationofMeetings.RegularlyscheduledmeetingsoftheEPPCmaybecancelledorrescheduledupondeterminationbytheChair.AnycancelledmeetingrequiresnotificationtotheCommunityDevelopmentDirectorinanefforttoadequatelynotifythepublic.E.MeetingProcedures.Chairshallpresideinaccordancewithgenerallyacceptednormsfortheconductofparliamentaryprocedure.TheEPPCmayoverturnaparliamentarydeterminationoftheChairbymajorityvote.Robert’sRulesofOrdermaybeconsideredasaparliamentaryguide.F.OpenMeetings.AllmeetingsandactionoftheEPPCshallbeinfullcompliancewithstatestatutesgoverningopenmeetings,asamendedandincorporatedhereinbyreference.ItistheresponsibilityoftheassignedstaffmemberofCommunityDevelopmenttobefamiliarwiththesestatutesandregulations.G.AttendancebyNon-members.MeetingsmaybeattendedbypersonswhoarenotmembersoftheEPPC.AtthediscretionoftheChair,non-membersmaybeallowedtospeakatmeetings.However,innoeventshallnon-membersbeallowedtovoteonmattersforwhichavoteisrequired.Ill.MEMBERSANDQUORUMA.Membership.TheEPPCconsistsoffive(5)votingmembers,asprovidedintheDevelopmentCode.AppointmentsofmembersshallbemadebytheTownBoardinaccordancewithPolicy102.B.Terms.Membersshallbeappointedtoasix(6)yearterm.Thetermsofthemembersshallbestaggeredsothatthetermsofanequalnumberofthemembers,orasequalanumberaspossible,expireonthelastdayofMarcheverytwoyears,asdescribedinsection31-23-203(3),C.R.S.Therearenotermlimitations,andmembersmaybereappointedbytheTownBoardinaccordancewithPolicy102.C.Vacancies.VacantpositionsshallbefilledbyappointmentbytheTownBoardfortheunexpiredportionofthetermofthepositiontobefilled.D.Quorum.AquorumfortransactionofbusinessoftheEPPCshallconsistof3membersoftheEPPC.Thisistheminimumnumberofmembersrequiredtobepresenttoopenameetingandconductbusiness.E.Action.AnyactionbytheEPPCshallbebymajorityvoteofthemembersattendinganyregularorspecialmeetingatwhichaquorumispresent,unlessotherwiseprovidedbylaworordinance.Atievoteshallconstitutefailureofthemotiononthefloor. F.TownBoardLiaison.TheTownBoardmayappointoneofitsmembersasaliaisontotheEPPC,whoshallreceivecopiesofallnotices,documents,andrecordsofproceedingsoftheEPPCwhichanymemberwouldalsoreceive.IV.OFFICERSA.Officers.ThereshallbeaChairandaVice-ChairaselectedbytheEPPC.B.Elections.Officersshallbeelectedbythemembersannually,attheregularlyscheduledmeetinginAprilofeachyear.OfficersshallbemembersoftheEPPC.NotificationofwhoiselectedChairandVice-ChairwillbesenttotheTownClerk.C.ChairResponsibilities:1.Presideatallmeetings2.Ensurethatallmeetingsareconductedwithdecorumandefficiency3.Callspecialmeetingsinaccordancewiththebylaws4.Authoritytocancelameeting5.SignanydocumentspreparedbytheEPPCforsubmissiontotheTownBoardorTowndepartments6.RepresenttheEPPCindealingswiththeTownBoardorotherorganizations7.TheChairhasthesamerightasanyothermemberoftheEPPCtovoteonmattersbeforetheEPPC,tomoveorsecondamotion,andtospeakfororagainstproposals.D.Vice-ChairResponsibilities:1.AssisttheChairasrequested2.AcceptandundertakedutiesdelegatedbytheChair3.PresideovermeetingsorperformotherdutiesoftheChairintheeventtheChairisabsentorunabletoact.E.ChairProTern.IntheabsenceoftheChairandVice-Chairatagivenmeeting,theCommissionmayelectavotingmembertoserveasChairforthedurationofthatmeeting.V.STAFFROLEAnassignedstaffmemberofCommunityDevelopmentisresponsibleforpropernotificationofmeeting,preparationanddistributionofagenda,assemblyofpacketandminutetakingforallmeetings.VI.ATTENDANCERegularattendancebythemembersoftheEPPCisexpected.Intheeventanymembermissesthree(3)consecutiveregularmeetingsoratotaloffour(4)regularmeetingsinacalendaryear,theTownBoardmayremoveitsappointedmemberforneglectofdutyanddesignateanewmembertofillthevacancy. VII.GENERALPROVISIONSRecommendationsforamendmentstothesebylawsmaybeadoptedatanyregularorspecialmeetingoftheEPPCbyamajorityofthemembershipoftheEPPCprovidedthatnoticeofsuchpossibleamendmentsisgiventoallmembersatleastfive(5)dayspriortothemeetingatwhichactionistobetaken.AnyamendmentsshallbesubjecttoapprovalbytheTownBoard.VIII.COMPLIANCEWITHTOWNPOLICIESA.Inadditiontothesebylaws,theEPPCshalloperateincompliancewiththeadoptedTownBoardpolicyonTownCommittees,Policy102,asamended.Thetermsofthispolicyareincorporatedintothesebylawsbythisreference.Acopyofthepolicy,alongwiththesebylaws,shallbeprovidedtoeachmemberatthetimeoftheirappointment.B.FailuretocomplywithapplicableTownpoliciesmaybegroundsforanofficialreprimandorcensurebytheEPPCand/orarecommendationtotheTownBoardforremoval.IX.CONFLICTOFINTERESTAllmembersoftheEPPCaresubjecttothestandardsofconductundertheStateofColoradoCodeofEthics,Sections24-18-101etseq.,C.R.S.,andArticleXXIXoftheColoradoConstitution(Amendment41).AtthetimeofintroductionofanindividualitemontheEPPCagendainwhichthememberhasaconflictofinterest,themembershallstatethataconflictofinterestexistsandthenabstainfromparticipatingandvotingonthematter.AmemberhavingaconflictofinterestonanymattershallnotattempttoinfluenceothermembersoftheEPPCatanytimewithregardtosaidmatter.czfAdoptedthisdayofO,hUCL*.L,2022.ESTESPARKBOARDOFTRUSTEES
