36RECEPTION#20210113584,12116/202110:02:55AM,1of5,$33.00AngelaMyers,Clerk&Recorder,LanmerCounty,CoGRANTOFUTILITYEASEMENTTHISGRANTOfUTILITYEASEMENTismadethis19thdayofOctober2021,byandbetweenByronLea(“Grantor”),whoseaddressis6753Hwy36,EstesPark,CO80517,andtheTOWNOfESTESPARK,COLORADO,aColoradomunicipalcorporation(“Town”).WITNESSETH:FORGOODANDVALUABLECONSIDERATION,theadequacyandreceiptofwhichisherebyacknowledged,Grantorhasthisdaybargained,sold,conveyed,transferred,anddelivereduntotheTown,itssuccessors,andassigns,inperpetuity,anexclusiveeasementin,over,under,through,andacrosstherealpropertydescribedbelowforpurposesofconstructing,repairing,replacing,relocating,inspecting,operating,maintaining,markingbysuitablemarkerssetandmaintainedintheground,andaccessingTown-ownedutilitysystemsacross,through,upon,overandundertherealpropertydescribedbelow;provided,however,thattheTownshallmakeeveryeffortreasonabletorestorethegroundsurfacetoitspriorconditionafteranydisturbanceofsuchsurface.Theterm“Town-ownedutilitysystems,”asusedherein,shallincludeaboveandbelowgroundwires,lines,cables,ducts,conduits,pipes,pumps,pedestals,risers,poles,vaults,manholes,firehydrants,ditches,culverts,inletsandanyotherequipment,appurtenances,andstructuresassociatedwithelectric,water,coimunications,andstorrnwatersystemsthatareownedandoperatedbytheTown.Theterm“exclusiveeasement”means:thatGrantorisprohibitedwithoutpriorwrittenapprovalfromtheTownfromconstructingorplacingonanypartoftheeasementanyfenceorgate,building,aboveorbelowgroundutilitysystems,appurtenances,trees,shrubsorvegetationnotownedormaintainedbytheTown,oranyotherpermanentorsubstantialstructure,orinanywaymodifyingtheTown-ownedutilitysystemsortheirlateralorsubjacentsupport.TheTownshallbepermittedtoimmediatelyremovewithoutliabilityfordamagesanyobstructionprohibitedbythiseasementthatinterfereswiththeTown’saccesstotheTown-ownedutilitysystemsorimpairstheTown’sfullfreeuseandexerciseoftheeasement,TheGrantorcovenantsandagreestocausetheeasementareaandanyimprovementsinstalledthereonotherthantheTown-ownedutilitysystems,tobemaintainedandkept,atitssolecostandexpense,ingoodconditionandstateofrepair.Togetherwiththerighttoenteruponsaidpremises,survey,construct,maintain,operate,controlandusesaidutilityfacilitiesandtoremoveanyobjectsinterferingtherewith,includingreestablishingdrainagecontours,trimmingandremovalofbushes,treesandothervegetation,andtherighttopermittheconstruction,operationandmaintenanceofutilityfacilitiesofaseparateutility,whetherornotownedbytheTown.TheGrantorreservestherighttocultivate,useandoccupysaidpremisesforanypurposeconsistentwiththerightsandprivilegesabovegranted.TheGrantoragreestoindemnifyandholdharmlesstheGranteeanditsofficersandemployeesfromanyandallsuits,claims,damages,liabilityorcourtawards,includingcostsandattorneyfeesthatareormaybeawardedasaresultofanyloss,injuryordamagesustainedorclaimedtohavebeensustainedbyanyoneincludingbutnotlimitedtoanyperson,firm,partnershiporcorporationinconnectionwithorarisingfromGrantor’suse,maintenance,oroperationoftheeasementareaoranyorallofitsimprovementsinstalledthereon.Rev.1-2021170MagregorAe/EstesPark,CO80517
