RECEPTION#20210113582,12/16/2021100255AM1015,$33.00AngelaMyers,Clerk&Recorder,LanmerCountyCOGRANTOFUTILITYEASEMENTTHISGRANTOFUTILITYEASEMENTismadethis5thdayofOctober,2021,byandbetweenLindsayLamson(“Grantor”),whoseaddressis6677EHighway36,EstesPark,CO80517APN24110-00-012,andtheTOWNOfESTESPARK,COLORADO.aColoradomunicipalcorporation(“Town”).WITNESSETH:FORGOODANDVALUABLECONSIDERATION,theadequacyandreceiptofwhichisherebyacknowledged,Grantorhasthisdaybargained,sold,conveyed,transferred,anddelivereduntotheTown,itssuccessors,andassigns,inperpetuity,anexclusiveeasementin,over,under,through,andacrosstherealpropertydescribedbelowforpurposesofconstructing,repairing,replacing,relocating,inspecting,operating,maintaining,markingbysuitablemarkerssetandmaintainedintheground,andaccessingTown-ownedutilitysystemsacross,through,upon,overandundertherealpropertydescribedbelow;provided,however,thattheTownshallmakeeveryeffortreasonabletorestorethegroundsurfacetoitspriorconditionafteranydisturbanceofsuchsurface.Theterm“Town-ownedutilitysystems,”asusedherein,shallincludeaboveandbelowgroundwires,lines,cables,ducts.conduits,pipes,pumps,pedestals,risers,poles.vaults,manholes.firehydrants,ditches,culverts.inletsandanyotherequipment,appurtenances,andstructuresassociatedwithelectric,water,communications,andstormwatersystemsthatareownedandoperatedbytheTown.Theterm“exclusiveeasement’means:thatGrantorisprohibitedwithoutpriorwrittenapprovalfromtheTownfromconstructingorplacingonanypartoftheeasementanyfenceorgate,building,aboveorbelowgroundutilitysystems,appurtenances,trees,shrubsorvegetationnotownedormaintainedbytheTown,oranyotherpermanentorsubstantialstructure,orinanywaymodifyingtheTown-ownedutilitysystemsortheirlateralorsubjacentsupport.TheTownshallbepermittedtoimmediatelyremovewithoutliabilityfordamagesanyobstructionprohibitedbythiseasementthatinterfereswiththeTown’saccesstotheTown-ownedutilitysystemsorimpairstheTown’sfullfreeuseandexerciseoftheeasement.TheGrantorcovenantsandagreestocausetheeasementareaandanyimprovementsinstalledthereonotherthantheTown-ownedutilitysystems,tobemaintainedandkept,atitssolecostandexpense,ingoodconditionandstateofrepair.Togetherwiththerighttoenteruponsaidpremises,survey,construct,maintain,operate,controlandusesaidutilityfacilitiesandtoremoveanyobjectsinterferingtherewith,includingreestablishingdrainagecontours,trimmingandremovalofbushes,treesandothervegetation,andtherighttopermittheconstruction,operationandmaintenanceofutilityfacilitiesofaseparateutility,whetherornotownedbytheTown.TheGrantorreservestherighttocultivate,useandoccupysaidpremisesforanypurposeconsistentwiththerightsandprivilegesabovegranted.TheGrantoragreestoindemnifyandholdhanrilesstheGranteeanditsofficersandemployeesfromanyandallsuits,claims,damages,liabilityorcourtawards,includingcostsandattorneyfeesthatareormaybeawardedasaresultofanyloss,injuryordamagesustainedorclaimedtohavebeensustainedbyanyoneincludingbutnotlimitedtoanyperson,firm,partnershiporcorporationinconnectionwithorarisingfromGrantor’suse,maintenance,oroperationoftheeasementareaoranyorallofitsimprovementsinstalledthereon.Rev.1-2021I170MagregorAveTEstesPark,CO80517
