The Committee recommends accepting Waterworks Sales bid.
RAW WATER PURCHASE OFFER BY DAVID ANDERSON:
Town Administrator Hill advised of an offer to the Town of
1 c.f.s.on the Big Thompson with the seller offering to change
the point of diversion to deliver at Glacier Creek.Total cost
of the water would be approximately $150,000.00 to $160,000.00.
The Committee recommends rejecting the offer.The Six City
Water project will obligate the Town up to its economic limit at
this time.
1975 CONSTRUCTION PROGRESS:
Superintendent McCracken reported progress as follows:
1.MacGregor 4”line segment completed and the TOW reseeded.
BIG THOMPSON PLANT:
Consulting Water Engineer Kemp discussed the plant overflow
problems and suggested methods of correcting or controlling
the problem.The Committee requested that Mr.Kemp advise as
to the cost of the following methods prior to the next meeting:
1.Approximately 4000’of 6”or 8”drain line.
2.An alarm system and effectiveness
3.Alternate plans.

HOSPITAL SPRINKLER SYSTEM:
Superintendent McCracken reported that a request had been made
by the hospital for approval of a sprinkling system design.The
design was referred to Consulting Engineer Kemp for approval and
advice as to the equivalent water fixture count for the purpose
of billing the water rights fee.Water recruirement for the
design presented is twenty-eight (2$)gallons per minute.
REPORT ON SIX CITY WATER:
Town Administrator Hill presented a letter and agreement form
from the Northern Colorado Water Conservancy District,Municipal
Subdistrict to Mr.Twitchell,Boulder City Manager,concerning
Windy Gap water.Mr.Hill advised of the estimated cost for one
year’s water use for 4,000 a.f.of Windy Gap water which amounts
to $145,640.00.The letter and agreement form is attached and
made a part of these minutes.

At its May 9,1975,meetIng,the Board of Directors of the Municipal
Subdistrict authorized and directed that,In response to the requests by the
City of Boulder,you be advised as follows:
1.That,if the total cost of the Windy Gap Project,as determined
by the final engineer’s estimate,exceeds $700.00 per acre—foot
of water to be dev.loped,the Board will,prior to awarding a
construction contract,advise all Subdistrict allottees and
discuss the feasibility of proceeding with th.project.
2.That,If a full one—sIxth (80 unIts)of the Windy Gap water
supply Is not petitioned for initially by one or mote of the
original Six Cities,the Board will give the other original
cities oppottunity to petition for such water before considering
petitions by any other entity.The distribution of any such
remaining water between the original cities will be.In accord
ance with the agreement of February 24,1969,between said
original six cities.if all of the Windy Gap water supply
(L+80 units)Is not petitioned for by the original cities in
accordance with said agreement,the Board will consult with
the then ptoent allottees prior to grantingan allotment to
any other petitioning entity.
3.That,prior to approval of the transfer of all or part of any
allotment,the Board will consult with the other then present
allottees concerning the desirability of approving the trans
fer and the financial capabilities of the proposed transferee.

AGREEMENT
BETWEEN MUNICIPAL SUBDISTRICT,NORTHERN COLORADO
WATER CONSERVANCY DISTRICT AND PETITIONERS OF
WATER FROM MUNICIPAL SUBDISTRICT
WHEREAS,each of the undersigned has petitioned Municipal
Subdistrict,Northern Colorado Water Conservancy District for an
allotment of Subdistrict water as defined in a Water Allotment
Contract,for annual delivery upon completion of the Windy Gap
Project and so long thereafter as the petitioners fully comply
with all the terms,obligations and conditions therein set forth;
and
WHEREAS,the undersigned petitioners have determined
that it would be in the best interests of Municipal Subdistrict
and said petitioners to provide for the beneficial use of the waters
developed by Municipal Subdistrict from the Windy Gap Project at the
earliest date possible in order that a final decree thereon may be
obtained;and
WHEREAS,the costs to be incurred in making the beneficial
use of said waters,when available,could create an economic hardship
on one or more of said petitioners in the year in which said use
should be made;
NOW,THEREFORE,IN CONSIDERATION OF THE TERMS AND CONDITIONS
HEREOF,IT IS AGREED AS FOLLOWS:
1.Municipal Subdistrict will create a reserve pursuant
to the provisions of Article 5(a)sufficient to divert,pump,store
and make beneficial use in any water year of the entire available
supply of water developed by Municipal Subdistrict from the Windy
Gap Project in an amount of approximately 48,600 acre feet,and,
if desirable,shall provide in its bond indenture or indentures ior
the creation of said reserve.
2.Municipal Subdistrict shall divert,pump,store and
make available for beneficial use by the petitioners said avail
able water supply of Subdistrict fom the Windy Gap Project for
use by petitioners at the earliest possible date,and after the
beneficial use of said water by the petitioners shall finalize,
as soon as possible,the decree therefor.
3.Municipal Subdistrict and petitioners agree that if
a petitioner is unable to make beneficial use of its full allotment
in the year requested that petitioner shall transfer the right to
the utilization of said water to another then allotte for purposes
of making beneficial use of said water notwithstanding the provisions
of the last sentence in Article 4 of the Water Allotment Contract.
4.The petitioners hereby agree that at the request of
the Board of Municipal Subdistrict each petitioner shall request
its entire allotment of Subdistrict water for the purpose of
establishing the total beneficial use thereof in any one water
year chosen by the Board of Municipal Subdistrict,and each further
agrees that the reserve created may be used by Municipal Subdistrict
to cover the cost of diverting,pumping,storing and making complete
beneficial use of the water supply of the Windy Gap Prject.
