RURAL WATER APPLICATIONS:
RON HENNINGSEN submitted a request for water service to his property
located on Fall River Road.Because the property is located above
the blue line,the Committee recommends approval subject to the
Henningsens being responsible for installing and maintaining a pump
if necessary.The Committee also recommends this application be
approved subject to annexation of the property.
STANLEY PEDERSEN submitted a request for water service at Lot 2,John
Pedersen property.The Committee recommends approval subject to
annexation of the property.
LIENEMANN WATER PUMPING AGREEMENT:
Town Administrator Dale Hill stated that on August 23,1971,the Town
and Mr.Lienemann executed an agreement that furnishes water service
to Mr.Lienemann’s development.In that resolution,under 4 A,there
is a paragraph that indicates how the Town will charge Mr.Lienemann,
which is $30.70 per lot.In a letter dated January 31,1983,Mr.
Lienemann states that the fee charged should be per unit.The Town
advised Mr.Lienemann that the fee charged is on a per lot basis and
we have billed him as such.Administrator Hill stated that the agreement
can be amended by resolution and he feels the fee basis should be changed
from a per lot fee to a per unit fee.The Town bills at the first of the
year for the previous year.If the Committee decides to change the
agreement,it could be effective as of January 1,1982.Attorney White
reported that he does not have a problem substituting units for lots.
The Committee recommends amending the resolution to indicate that the
calculations used should be based on the number of water connections
on the property.The Committee recommends that the Town Attorney
redraft the resolution to reflect this change.
Administrator Hill also reported on the cost to operate the Fall
River Estates Pumping Station which was $1,512.46 for 1982.We
are also having to bleed the lines because of freezing and for
January,February,and March of 1982,we used 1,245,000 gallons
of water,and for December 1982 and January,1983,we used 304,358
gallons of water.
PROSPECT ESTATES WATER AGREEMENT:
One year ago,the Town drafted a water agreement for Prospect Estates
and the Water Committee directed the staff to keep track of the
costs for one year before executing the contract.Administrator
Hill reported there were no costs accounted for in this past one—
year period due to the fact that the system was not completed and
was not in service.Prospect Estates has indicated they will soon
request permission to have completed units occupied providing
adequate fire protection is in existence.The pumping plant has
been used to pressure test the system.The Committee recommends
that Town Attorney Greg White proceed with the execution of the
proposed water agreement and also recommends that no further water
taps be issued until the agreement is signed.

The Committee reviewed a letter dated January 26,1983,from DMJM
Phillips,Reister,Haley,Inc.regarding the Prospect Estates pump
station and storage tank.The letter states that there are several
deficiencies regarding these structures.The Committee recommends
checking with the Town Attorney regarding the Town’s legal position
in bringing the developer into compliance with the regulations as
outlined by DMJM Phillips,Reister,Haley,Inc.
STANLEY HILLS ASSOCIATION -STORM WATER RETAINING PONDS:
A letter dated January 25,1983,from Rowland Retrum,President
of the Stanley Hills Association was considered by the Committee.
The Stanley Hills Association is requesting the Town flush the upper
water retaining pond two or three times each summer using hydrant
water in an estimated amount of 30,000 gallons.The Committee
recommends helping the Association by flushing their pond and
charging them the normal water rate,plus overtime labor (overtime
labor as the work will need to be done at night).
1983 CAPITAL IMPROVEMENT PROGRAM:
Water Superintendent McCracken proposed the following water improvement
projects for 1983:

The Committee recommends approval of the 1983 water improvement
projects,purchasing the new portable chemical feeder,and proceeding
with obtaining bids for the Everett Lumber 8”line as well as obtaining
bids on replacing the Tractor.

REPORTS:
Town Administrator Hill suggested that the surplus Windy Gap water
disposal efforts be delayed 2—3 months because of some changes in
boundary lines,etc.through the Municipal Sub-district.
The augmentation suit with NCWCD will be held at 9:00 a.m.in the
State Supreme Court on March 8,1983.Administrator Hill will
inform the Committee of the approximate length of the trial for
those wishing to attend.
January 1923 water use showed a +8.26%increase from January 1982
and a +.76%increase from December,1982.The total percent of
water accounted for as of January 13,1983,is 90.26%.
