Chairman Dickinson called a special meeting of the Water Commit
tee to order at 1:39 P.M.
PHIL MOENNING -APPEAL OF TAP FEE DETERMINATION -CONTINUATION.
Bill Van Horn,representing Phil Moenning,appeared before the
Committee to advise of additional information.In reviewing the
Town’s archives,Mr.Van Horn found that in some instances,the
Town Board did grant free taps for acquisition of right-of-way.
The Town charged $10.00 for a tap fee.Taps larger than 5/8”
required the Town’s permission;however,there is no record of
any appeals to the Town Board for taps larger than 5/8”.In Mr.
Van Horn’s opinion,history indicates the taps were not limited
in size until the Town made taps more valuable.Mr.Moenning
desires a 2”tap plus 1,000 fixture value units free—of—charge.
Chairman Dickinson requested and received permission from the
Committee to enter executive session to discuss the counter—offer
submitted this date by Mr.Moenning.The meeting adjourned to
executive session at 1:53 P.M.
Chairman Dickinson reconvened the Special Water Committee meeting
at 2:27 P.M.
Trustee Garrett moved the Committee resubmit the Town’s position
stated during the May 24,1988 Town Board meeting,requesting
Town Attorney White to orally state said position,as follows:
1.The Town will provide Mr.Moenning with a 2”tap,
including all plant development fees,the value being
$9,515.00.Mr.Moenning will be responsible for all
water rights fees payable according to the total amount
of fixture values served by the tap.In addition,Mr.
Moenning shall pay for all service line installation and
materials,including,but not limited to,a meter,
remote meter readout,pressure reducer,and backflow
preventer.
2.In the event Mr.Moenning desires to increase the size
of the tap,he will receive a credit in the amount of
$9,515.00 towards the purchase of a larger tap.
3.In the event Mr.Moenning desires to surrender and
abandon the three 3/4”taps,or any one of them,he will
also be entitled to a credit of $3,238.00 for each
surrendered tap.
4.Acceptance of this proposal of the Town is conditioned
upon Mr.Moenning waiving all claims for any other water
taps or rights pursuant to the terms and conditions of
the October 2,1940 Deed.

Chairman Dickinson concurred with Trustee Garrett’s motion.Town
Attorney White advised the aforementioned position was stated in
a letter dated May 27,1988 submitted to Mr.Moenning’s legal
counsel.
There being no further business,Chairman Dickinson adjourned the
meeting at 2:30 P.M.
