aESTESPARKURBANRENEWALAUTHORITYRESOLUTIONNO.2008-ARESOLUTIONAPPROVINGTHEURBANRENEWALPLANFORTHEESTESPARK21STCENTURYURBANRENEWALPROJECTWHEREAS,inJanuaryof2007,theEstesParkUrbanRenewalAuthority(theAuthority)commissionedaconditionssurveyandretainedTenanceWareAssociates(theConsultant)toconductstudiesandsurveysofthearea(Area)describedthereintodetermineiftheAreacontainsfactorsincludedinthedefinitionofblightedareaintheColoradoUrbanRenewalLawSections31-25-101,etseq.,C.R.S.,(theAct);andWHEREAS,theConsultantprepared,submitted,andpresentedtotheAuthorityadocumententitledAnAnalysisofExistingConditionsRelatingtoBlightTownofEstesPark(theSurvey)datedAugust2007,whichSurveyisincorporatedhereinbythisreference,andwhichdescribesindetailtheconditionsintheArea;andWHEREAS,therehasbeenpreparedforreviewbytheAuthoritytheUrbanRenewalPLanfortheEstesPark21CenturyUrbanRenewalProject(thePlan),acopyofwhichisattachedheretoandincorporatedherein;NOW,THEREFORE,BEITRESOLVEDBYTHECOMMISSIONERSOFTHEESTESPARKURBANRENEWALAUTHORITY,THAT:Section1.BasedontheSurvey,theUrbanRenewalAreadescribedinthePlanisfound,declared,andrecommendedtotheBoardofTrusteesoftheTownofEstesPark,Colorado,tobeablightedareaasdefinedintheAct.Section2.TheboundariesoftheUrbanRenewalAreahavebeendrawnasnarrowlyasfeasibletoaccomplishtheplanninganddevelopmentobjectivesofthePlan.Section3.ThePlanhasbeensubmittedtotheBoardofCountyCommissionersofLarimerCounty,Colorado,(theCounty)togetherwiththeinformationrequiredbySection31-25-107(3.5)oftheAct.Section4.ParkSchoolDistrictNo.R-3hasbeenpennittedtoparticipateinanadvisorycapacitywithrespecttotheinclusioninthePlanofthetaxallocationprovisionsauthorizedbySection31-25-107(9)oftheAct.Section5.ItisnotexpectedorintendedthattheAuthoritywillrelocateanyindividualsandfamiliesinconnectionwiththePlan,buttotheextentthatanysuchrelocationmayberequired,afeasiblemethodexistsfortherelocationofindividualsandfamiliesindecent,safe,andsanitarydwellingaccommodationswithintheirmeansandwithoutunduehardshiptosuchindividualsandfamilies. GCSection6.ItisnotexpectedorintendedthattheAuthoritywillrelocateanybusinessconcernsinconnectionwiththePlan,buttotheextentthatanysuchrelocationmayberequired,afeasiblemethodexistsfortherelocationofsuchbusinessconcernsintheUrbanRenewalAreaorinotherareasthatarenotgenerallylessdesirablewithrespecttopublicutilitiesandpublicandcommercialfacilities.Section7.ReasonableeffortshavebeenmadetoprovidewrittennoticeofthepublichearingprescribedbySection31-25-107(3)oftheActtoallpropertyowners,residents,andownersofbusinessconcernsintheproposedUrbanRenewalAreaattheirlastknownaddressesatleastthirtydayspriortothepublichearingonthePlan.Section8.Section31-25-107(4)(d)oftheActwillnotapplybecausenotmorethan120dayswillhavepassedsincethecommencementoftheonlypublichearingonthePlan.Section9.Section31-25-107(4)(e)oftheActdoesnotapplybecausetheTownBoarddidnotfailtopreviouslyapprovethisPlan.Section10.ThePlanconformswiththe1996EstesValleyComprehensivePlan,whichisthegeneralplanforthedevelopmentoftheTownofEstesParkasawhole.Section11.ThePlanwillaffordmaximumopportunity,consistentwiththesoundneedsofthemunicipalityasawhole,fortherehabilitationorredevelopmentoftheUrbanRenewalAreadescribedinthePlanbyprivateenterprise.Section12.AlloftheUrbanRenewalAreaiswithinthecorporatelimitsoftheTownandisanareathathasbeenbuilt-upformanyyears.Itconsistsoftheprincipalgovernmental,commercial,andretailareasoftheTown.ConstructionofpublicimprovementsandprovisionofservicesintheUrbanRenewalAreawillbetheprimaryresponsibilityoftheTown,theAuthority,privateenterprise,andprovidersofpublicentitiesotherthantheCounty.TheCountyhasnotprovidedinformationthatanyadditionalcountyinfrastructureandserviceswillberequiredtoservedevelopmentintheUrbanRenewalAreawhilethetaxallocationprovisionsauthorizedbySection3l-25-l07(9)(a)(1)and(II)oftheActareinplacethatarenotoffsetbyincreasedrevenuesfromthe2007expirationofthetaxallocationprovisionsinplacewithinaportionoftheUrbanRenewalArea,increasesinCountyrevenueresultingfromtheproportionateadjustmentofthevaluationsforassessmentundersubparagraphs(I)and(II)ofSection31-25-l07(9)(a)oftheAct,andtheincreaseinnewCountysalestaxrevenueresultingfromredevelopmentintheUrbanRenewalAreaasdescribedintheimpactreportprovidedtotheCountypursuanttoSection31-25-107(3.5)oftheAct.SuchrevenueincreaseswilladequatelyfinanceanyadditionalCountyinfrastructureorserviceswhilesuchtaxallocationprovisionsareineffect.Section13.TheUrbanRenewalAreadescribedinthePlanisabuiltupareaanddoesnotconsistofopenlandwithinthemeaningofSections31-25-107(5)and107(6)oftheAct.Theprincipalpublicpurposefortheurbanrenewalplanistofacilitateredevelopmentinordertopreventthespreadofphysicallyblightedareas. aSection14.TheUrbanRenewalPlanfortheEstesPark21StCenturyUrbanRenewalProjectAreahasbeendulyreviewedandconsideredandisherebyapproved.TheAuthorityrecommendstotheBoardofTrusteesofEstesParkthatitapproveandadoptthePlanandauthorizetheAuthoritytotakeanyandallactionspursuanttotheActtocarryoutthePlan.ADOPTEDANDAPPROVEDTHIS1DAYOf,200$.ESTESPARKBy:Attest:By:)JChairmanSecy(ary
