Home My WebLink AboutEPURA RESOLUTION 364RESOLUTIONNO.364ARESOLUTIONOFTilEESTESPARKURBANRENEWALAUTHORITYAUTHORIZINGTHECHAIRMANTOENTERINTOANAGREEMENTWITHTHECULTURALARTSCOUNCILOfESTESPARKRELATIVETOTHEPOSSIBLEPURCHASEOFCONDOMINIUMUNITEINRIVERSPOINTEDOWNTOWNWHEREAS,theEstesParkUrbanRenewalAuthority(EPURA)isacquiringCondominiumUnitEinRiverspointeDowntown,a4,750squarefootfmishedshellfrontingontheRiveiwalk,ascompensationforitsinvestmentinacquiringthesiteofRiverspointeDowntown;andWHEREAS,thegoalofEPURAissellUnitEtothemostappropriateusertoenhancethebusinessneighborhood,benefittheTownofEstesPark,andrecoupitsinvestmentinatimelymannersothatitcanproceedwithothercommunityimprovementprojects;andWHEREAS,theCulturalArtsCouncilofEstesPark(CACEP)hasexpressedinterestinacquiringUnitEforuseasaperformingartsandvisualartscomplex,ausethatEPURAfeelswouldenhancethearea;however,CACEPisfacedwithafund-raisingendeavorinordertopurchaseUnitE;andWHEREAS,timeisoftheessenceinorderforEPURAtorecoupitsinvestmentandproceedwithitsscheduledprojectsinatimelymanner;therefore,itbehoovesEPURAandCACEPtoestablishanagreement,includingatimeline,forCACEP’spurchaseofUnitE.IfitevolvesthatCACEP’spurchaseisnotfeasible,EPURA’sgoalisfindanalternativeuser,orusers,in2005andhavetheUnitEspaceinusebysummerof2006.NOW,THEREFORE,BEITRESOLVEDBYTHEESTESPARKURBANRENEWALAUTHORITYTHAT:TheEPURAChairmanisherebyauthorizedtoenterintoanagreementwithCACEPthatwillprovideampleopportunityforCACEPtoacquireUnitFandatthesametimeenableEPURAtorecoupitsinvestmentattheearliestpossibletime,consistentwiththegoalsstatedabove.ADOPTED,this20thdayofApril,2005ATTEST:Secretary’ESTESPChainnan
