CaRESOLUTIONNO.352ARESOLUTIONOFTHEESTESPARKURBANRENEWALAUTHORITYAPPROVINGTHECONCEPTOFANINTERGOVERNMENTALAGREEMENTWITHESTESPARKFIREPROTECTIONDISTRICTWHEREAS,theServicePlanfortheproposedEstesParkFireProtectionDistrictwasfiledinLarimerCounty,Colorado,onApril1,2004;andWHEREAS,theServicePlanwasapprovedbytheLarimerCountyBoardofCommissionersonJune1,2004;andWHEREAS,aPetitionhasbeenfiledintheDistrictCourt,LarimerCounty,Colorado,requestingformationoftheEstesParkFireProtectionDistrict;andWHEREAS,ahearingonsaidPetitionhasbeensetforAugust2,2004,andWHEREAS,itisanticipatedthattheDistrictCourtwillrefertheformationoftheEstesParkFireProtectionDistricttotheeligibleelectorsoftheDistrictatthegeneralelectionofNovember2,2004;andWHEREAS,asapartoftheformationoftheEstesParkFireProtectionDistrict,theeligibleelectorswillbeaskedtoapproveamilllevyof3.5millstofundtheoperation,includingcapitalexpenditures,oftheEstesParkFireProtectionDistrict;andWHEREAS,aportionofrealandpersonalpropertywhichwillbesubjecttothemilllevyof3.5millsoftheEstesParkFireProtectionDistrictlieswithintheboundariesofEPURA;andWHEREAS,theUrbanRenewalLaw(Sections31-25-101et.seq.C.R.S.)doesnotspecii,’astowhetherornotadvalorempropertytaxesleviedbytheEstesParkFireProtectionDistrictshallbepaidintothefundsofEPURA;andWHEREAS,saidtaxrevenue,ifreceivedbyEPURA,wasnotcontemplatednorexpectedtofundanycurrentorfutureEPURAUrbanRenewalProjects;andWHEREAS,itisthedeterminationoftheUrbanRenewalBoardthatintheeventtaxrevenuesarereceivedbyEPURAastheresultofthelevyingofadvaloremtaxonrealandpersonalpropertylocatedwithinEPURA’sboundariesbytheEstesParkFireProtectionDistrict,saidrevenuesshouldbereturnedtotheEstesParkFireProtectionDistrictforusebytheDistrict;and 00WHEREAS,theappropriatemethodforaccomplishingsaidtransferistoenterintoanIntergovernmentalAgreementwiththeEstesParkFireProtectionDistricttosetforththetennsandconditionsofthereturnofsaidtaxrevenuestotheDistrict.NOWTHEREFORE,BEITRESOLVEDBYTHEESTESPARKURBANRENEWALAUTHORITYthat:1.IntheeventtheEstesParkFireProtectionDistrictisformedandleviesanadvaloremtaxonrealandpersonalpropertylocatedwithintheboundariesoftheEstesParkUrbanRenewalAuthority,itisthepositionoftheEstesParkUrbanRenewalAuthoritythatrevenuesfromsaidadvaloremtaxreceivedbytheEstesParkUrbanRenewalAuthorityshouldbereturnedtotheEstesParkFireProtectionDistrictforusebytheDistrictforprovisionofitsauthorizedservices.2.TheappropriatemechanismfortransferoftheserevenuesshallbeinanIntergovernmentalAgreementnegotiatedbetweentheEstesParkFireProtectionDistrictandtheEstesParkUrbanRenewalAuthority.3.AnytransferoffundsfromtheEstesParkUrbanRenewalAuthoritytotheEstesParkFireProtectionDistrictshallbesubjecttoandcontingentuponapprovalofanappropriateIntergovernmentalAgreementbetweentheparties,andapprovalofthetermsandconditionsoftheIntergovernmentalAgreementbyBondCounseltotheEstesParkUrbanRenewalAuthoritywithregardtoalltaxincrementbondscurrentlyoutstandingoftheEstesParkUrbanRenewalAuthority.Datedthisl4tdayofJuly,2004.ESTESPARKURBANRENEWALAUTHORITYChairmanATTEST:
