HomeMy WebLinkAboutEPURA RESOLUTION 299C)’RESOLUTIONNO.299ARESOLUTIONOFTHEESTESPARKURBANRENEWALAUTHORITYTOAPPROVEANINTERGOVERNMENTALAGREEMENTREGARDINGTRANSFEROFREALESTATEANDREALESTATEOBLIGATIONSTOTHETOWNOFESTESPARKWHEREAS,theEstesParkUrbanRenewalAuthority(EPURA)requestedtheTownofEstesPark(theTown)toassumetheLeaseOptiontoPurchaseforLot2,StanleyKnollSubdivisionofTract2,StanleyAdditiontotheTownofEstesPark,commonlyreferredtoas“theKnoll”,sothatEPURAcanallocatemaximumresourcestowardtheWestCorridorproject;andWHEREAS,theTownBoardapprovedEPURA’srequesttoassumetheLeaseOptiontoPurchaseobligation,effectivetoincludetheJuly30,2001payment.ItwasmutuallyagreedthattitletoLots1and3,StanleyKnollSubdivisionofTract2,StanleyAdditiontotheTownofEstesPark,betransferredfromEPURAtotheTown,sothattheentire19.36acrescommonlyknownastheccKno11/Willowsbeunderonepublicownership;andWHEREAS,anIntergovernmentalAgreementhasbeendraftedbytheTownAttorney,describingtherequirementsandproceduretoaccomplishsaidfinancialobligationtransferandpropertytransfer.ThisIntergovernmentalAgreementhasbeenreviewedbyEPURAstaffandisunderreviewbyEPURAlegalcounsel.Staffrecommendsthatthatparagraph1.B.,whichwouldrequireEPURAtopayforatitleinsurancepolicypriortotransferringtitleofLots1and3totheTownbedeleted.Stafffurtherrecommendsthatthistransferbeaccomplishedbyasimplequitclaimdeed.Legalcounselispreparingrecommendationsrelativetoseveralparticulars.NOW,THEREFORE,BEITRESOLVEDBYTHEESTESPARKURBANRENEWALAUTHORiTYTHAT:TheChairmanoftheEstesParkUrbanRenewalAuthoritybeauthorizedtoexecutesaidintergovernmentalAgreementwiththedeletionofparagraph1.B.andsubjecttotermstobenegotiatedbyEPURAlegalcounsel,withtheapprovaloftheChairmanandtheExecutiveDirector.ADOPTEDthisdayofAugust,2001.ESTESPARKURBANRENEWALAUTHORITYr.,ChairmanATTEST:Secretary1
