Home My WebLink AboutEPURA RESOLUTION 28500RESOLUTIONNO.285ARESOLUTIONOFTHEESTESPARKURBANRENEWALAUTHORITYAMENDINGTHEJOINTDEVELOPMENTAGREEMENTDATEDAPRIL30,1999BETWEENNEWSTANLEYASSOCIATES,L.P.ANDTHEESTESPARKURBANRENEWALAUTHORITY,DEALINGWITHAPARKINGAREAANDIMPROVEDACCESSTOSERVESTANLEYHALLANDTHESTANLEYHOTELWHEREAS,theEstesParkUrbanRenewalAuthority(EPURA)hasenteredintoanagreementdatedApril30,1999withNewStanleyAssociates,L.P.(NSA)toparticipateintheconstructionofaparkingareaandimprovedaccesstoserveStanleyHallandtheStanleyHotel;andWHEREAS,theprojecthasbeendelayedandmodified,dueinparttotheproposalgoingthroughtherequiredTechnicalReviewbytheTownaftertheoriginalagreementhadbeenexecuted;andWHEREAS,themodificationstotheprojecttoaddresstheminimumrequirementsoftheTownTechnicalReviewCommitteeincludeadditionsintheareaofstormwaterrouting,detentionanddischarge;pedestrianconnectionsfromtheparkingareatothebuildingsserved;andre-vegetationofdisturbedareasatadditionalcosts,resultinginashortfallof$24,283.08relativetotheoriginalcostsagreeduponandsetasideinaspecialconstructionaccount;andWHEREAS,discussionshaveoccurredbetweenEPURAstaffandNSAastothemostappropriateandfairmeanstoaddressthisshortfall,theresultbeingthatNSAhasagreedtobearthecostsofsidewalkconnectionsandre-vegetationatacostofapproximately$18,200ifEPURAwillbearthedesignfeesof$10,592.01.Thiswillresultinareserveof$4,508.93intheconstructionaccount,basedontheaccountbalanceandthecontractor’sproposal,forpossiblecontingenciesandchangeorders.NOW,THEREFORE,BEITRESOLVEDBYTHEESTESPARKURBANRENEWALAUTHORITYTHAT:Inanefforttobringthisendeavortoanearlyandsatisfactoryconclusion,toadheretothespiritoftheoriginalagreementandtoaddresstherequirementsoftheTownTechnicalCommitteeinafairandequitablemanner,EPURAwillpaythedesignfeesrelevanttotheprojectintheamountof$10,592.01.ADOPTEDthis19thdayofApril,2000.ESTESPARKURBANRENEWALAUTHORITYChairman
