HomeMy WebLinkAboutEPURA RESOLUTION 226RESOLUTIONNO.226ARESOLUTIONOFTHEESTESPARKURBANRENEWALAUTHORITYDECLARINGANINTENTTOACQUIREREALPROPERTYINTHEREDEVELOPMENTAREAANDAUTHORIZINGSTAFFTOENTERINTOAPURCHASEOPTIONAGREEMENTSUBJECTTOCONDITIONSWHEREAS,inaccordancewiththeEstesParkDowntownRedevelopmentProgram(Plan)theKnoll,Lot2,StanleyKnollSubdivision,(Property)wasdesignatedforacquisitionforpublicpurposes;andWHEREAS,thePropertymaybeusedforpublicpurposesuchasparkingandpublicbuildings;and-WHEREAS,thePropertyisforsale;andWHEREAS,theAuthoritywillconductanopinionsurveytodeterminewhethertheAuthorityshouldpurchasethePropertyforpublicusesandwillactinresponsetosuchsurvey;andWHEREAS,theAuthoritydesirestoshowgoodfaithofitsintenttopurchasethePropertytotheowner,subjecttothepublicopinionsurvey,byenteringintoapurchaseoptionagreement.NOW,THEREFORE,BEITRESOLVEDBYTHEESTESPARKURBANRENEWALAUTHORITYTHAT:1.TheAuthoritydeclaresitsintenttoacquireaparceloflandknownasLot2,StanleyKnollSubdivisionsubjecttotheresponsefromtheopinionsurveyoftheresidentsoftheTownofEstesPark.2.TheProperty,ifacquired,willbeusedforpurposeswhichareincompliancewiththePlan.3.TheAuthorityisherebyauthorizedtoenterintoapurchaseoptionagreementtoallowtimefortheopinionsurveyandnegotiationwiththePropertyowner.4.TheStaffoftheAuthority,includinglegalcounsel,isauthorizedtopreparelegaldocumentsfortheoptionagreementandisauthorizedtoissuepaymentnot-to-exceed$5,000forsuchoption.5.TheStaffoftheAuthority,includinglegalcounsel,isauthorizedtotakeallnecessarystepsforacquisitionofsuchproperty,ifafavorableresponseisreceivedfromtheelectorate;subjecttoapprovalofanagreementtoacquirethePropertybytheBoardofCommissioners.ADOPTEDthis26thdayofJanuary1995.ESTESPARKURBANRENEWALAUTHORITY_-c--,iATTEST:Cliairman/’ASecretar—
