228cRESOLUTIONNO.228ARESOLUTIONOFTHEESTESPARKURBANRENEWALAUTHORITYAWARDINGACONTRACTTOROCKYMOUNTAINCONSULTANTSTOCONDUCTAPHASEIENVIRONMENTALSITEASSESSMENTOFLOT2,STANLEYKNOLLSUBDIVISIONWHEREAS,theEstesParkUrbanRenewalAuthoritywishestoleasepurchaseLot2,theStanleyKnollSubdivision;andWHEREAS,LegalCounselhasadvisedtheAuthoritythataPhaseIEnvironmentalSiteAssessmentbeconductedpriortoexecutionofaleasepurchaseagreement;andWHEREAS,quotestoconductaPhaseIEnvironmentalSiteAssessmentwereobtainedfromtwosources;andWHEREAS,RockyMountainConsultantswereabletomeetthetimescheduletoprovideapreliminaryreportpriortoMarch15thandwereequalincost.NOW,THEREFORE,BEITRESOLVEDBYTHEESTESPARKURBANRENEWALAUTHORITYTHAT:1.TheBoardofCommissionersoftheEstesParkUrbanRenewalAuthorityacceptstheattachedproposalfromRockyMountainConsultantsandherebycontractswiththemforservicesforaPhaseIEnvironmentalSiteAssessmentforLot2,StanleyKnollSubdivision,asperattachedproposal.2.Thecostofthiscontractshallnotexceed$2,500.ADOPTEDthis15thdayofMarch1995.ESTESPARKURBANRENEWALAUTHORITYATTEST:Chairm Mr.ArtAndersonMarch13,1995PageTwoandthesecondexcavationislocatedontheeast-centralportionofthesite.Theexcavationsareapproximatelytwofeetdeep,threefeetwide,andfivefeetlong.Excavatedrockandsoilisstockpiledadjacenttoeachexcavation.Onthedayofthesitereconnaissance,theexcavationsdidnotcontainanymaterials.PHYSICALSETTINGReviewoftheLarimerCounty,Coloradotopographicmap(Figure1)indicatestopographyatthesiteslopesgentlytomoderatelytothenorth,east,andwest.Shallowgroundwaterflowatthesitelikelymirrorstheoverallsitetopographywithflowgenerallytothenorth-northeast.SITEifiSTORYThesitehistorywasinvestigatedbyreviewingpropertytaxfiles,Citybuildingdepartmentrecords,historicarticlesattheEstesParklibrary,andlimitedaerialphotography.Otherpossiblehistoricsourcessuchasfireinsurancemapsandstreetindicescoveringthesitewereeitherunavailableornotreasonablyascertainable.Aerialphotographywaslimitedtorecentyears(1989,1991,and1993)asolderphotographswerenotreasonablyascertainable(notesregardingthelimitedaerialphotographicreviewareincludedonTable1).RECORDSREVIEWAreviewofFederalandStaterecords(asofJanuary5,1995)wasperformedtohelpidentifyrecognizedenvironmentalconditionsinconnectionwiththeproperty.Therecordsreviewedwere:theFederalNationalPriorityList(NPL);theFederalComprehensiveEnvironmentalResponseCompensationandLiabilityInformationSystem(CERCLIS);theFederalResourceConservationandRecoveryInformationSystem(RCRIS)forgeneration,treatment,storage,anddisposalofhazardousmaterials;theFederalEmergencyResponseNotificationSystem(ERNS)List;theStateLandfillList;theStateRegisteredUndergroundStorageTank(UST)List;andtheStateLeakingUndergroundStorageTank(LUST)List.Asofthiswriting,weareawaitingcompletionofEPA,CDPHE,OIS,andLCHDfilereviews.TheEPAwillprovidemoreuptodateCERCLIS,RCRIS,andERNSlistings.TheCDPHEand015willprovidemoreuptodateUSTandLUSTlists.TheLCHDwillprovidespecificenvironmentalinformationpertainingtothesiteandsurroundingarea.FederalNPLListAreviewoftheFederalNPLListindicatesnoNPLsitesarelistedwithinonemileofthesite.FederalCERCLISListAreviewoftheFederalCERCLISListindicatesnopotentialSuperfundsitesarelistedwithinonehalfmileofthesite. corncMr.ArtAndersonMarch13,1995PageThreeFederalRCRISListReviewoftheFederalRCRISListindicatesnohazardouswastegeneratorsarelistedforthesiteoradjoiningproperties.Onetransporterofhazardousmaterials,theColoradoDepartmentofTransportation,islistedapproximatelyoneandone-halfmilessouthwestofthesiteat526ElmDrive.FederalERNSListReviewoftheFederalERNSListfoundnolistingsofemergencyresponsesatthesubjectsite.StateLandfillListReviewoftheStateLandfillListpreparedbytheCDPHEindicatesnoactivelandfillsarelistedwithinone-halfmileofthesite.StateRegisteredUSTListNoUST’sareregisteredonthesiteorontheadjoiningproperties.StateLUSTListTheCDPHEhasdiscontinuedupdatestoitsLUSTList.ThefinalCDPHElistisdatedDecember15,1992.ReviewoftheCDPHElistindicatesoneLUSTsiteislistedwithinone-halfmileofthesite.Alpine66,locatedat561BigThompsonAvenue,isapproximately0.4miletotheeastofthesite.TheLUSTsiteisdowngradientofthesubjectproperty.TheOISalsokeepsrecordsofLUST’s.AJanuary,1995filereviewbytheOISdidnotindicatethepresenceofanyadditionalLUST’swithinone-halfmileofthesite.TheOISiscurrentlyresearchingtheserecords.TherecordsresearchwillindicateifaLUSThasbeenaddedtothelistsinceJanuary,1995.AGENCYREVIEWSRMCrequestedagencyreviewsbytheEPA,CDPHE,OIS,andtheLCHD.Asofthiswritingtheaforementionedagencieshavenotcompletedtheirreviews.REGULATORYINTERVIEWSRMCinterviewedMr.JackRumley,ChiefoftheEstesParkVolunteerFireDepartment.Mr.Rumleycouldnotrecallanyresponsestothesite.KEYSITEMANAGERINTERVIEWRMCinterviewedthetheowneroftheproperty,Ms.SandyRoche,andthepotentialpurchaser,Mr.ArthurAndersonwiththeEstesParkUrbanRenewalAuthority.Ms.RocheandMr.Anderson
