0RESOLUTIONNO.189ARESOLUTIONOFTHEESTESPARKURBANRENEWALAUTHORITYDETERMININGTHATTHEDEVELOPMENTPROPOSEDFORTHEELKHORNLODGEISNOTINCOMPLIAI’TCEWITHTHEESTESPARKDOWNTOWNREDEVELOPMENTPROGRAMWHEREAS,inaccordancewithSection17.36.020oftheEstesParkMunicipalCode,theproposedrelocationofausedbuildingontotheElkhornLodgepropertywassubmittedtotheEstesParkUrbanRenewalAuthorityfordeterminationofcompliancewiththeEstesParkDowntownRedevelopmentProgram(Plan);andWHEREAS,anoticeofpublichearingwaspublishedandpostedasrequiredbytheMunicipalCode;andWHEREAS,pursuanttotheMunicipalCode,theEPUPAstaffworkedwiththedevelopertoinsurethatsuchbuildingmeetstherequirementsofthePlan;andWHEREAS,apublichearingwasheldonFebruary4,1993,beforetheEPURABoardofCommissioners;andWHEREAS,allpersonsatsuchhearingwereaffordedafullopportunitytopresenttestimonyandevidencetotheBoardofCommissioners;andWHEREAS,theBoardofCommissionershasconsideredallofthetestimonyandevidencepresentedatthehearingandtheapplicant’sstatementofintentandproposedplanofdevelopment.NOW,THEREFORE,BEITRESOLVEDBYTHEBOARDOFCOMNISSIONERSOFTHEESTESPARKURBANRENEWALAUTHORITYTHAT:Basedontheapplication,staffmemorandum,testimony,comments,andevidencepresentedatthepublichearing,theBoardofCommissionersherebymakesthefollowingfindingsoffact:A.TheEstesParkDowntownRedevelopmentProgram(Plan)providesthat:“AlldevelopmentmustconformwithprovisionsandproposalsofthisPlanandwithallapplicablelaws,ordinances,andcodes.”(Page17,LandUseRegulationsandBuildingRequirements)TheTownofEstesPark(MunicipalCodeChapter14.12.010),hasadoptedthe1991UniformBuildingcode(UBC).TheUBCSection1205(d)states:%13Q a“Dwellingunits,congregateresidences,andlodginghousesshallbeprovidedwithabathroom,equippedwithfacilitiesconsistingofawatercloset,lavatoryandeitherabathtuborshower.Eachsink,lavatoryandeitherabathtuborshowershalllieequippedwithhotandcoldrunningwaternecessaryforitsnormaloperation.”UBCSection1212states:“Dwellingunits,guestroomsandcongregateresidentsshallbeprovidedwithheatingfacilitiescapableofmaintainingaroomtemperatureof70°Fatapointthreefeetabovethefloorinallhabitableroom.”TheApplicant,inhisletterofsubmissionstatesthatthisrelocatedbuildingwillbeused“asabunkhouseforwranglers”aswellas“tackstorage”.Hefurtherstates,“Weplanfornoheatingorplumbing.”B.TheMunicipalCodespecifiesinSection14.28.090BuildingtoConformtoBuildingCode:“BeforeapermitshallbeissuedunderthisChapter,anybuildingtobemovedeitherintoorwithintheTownmust,beforemovingthereof,complyineveryrespectaswouldacompletedbuilding,withtheBuildingcodetheninforceatthetimeoftherequestforapermithereunder.”TheApplicanthasnotprovidedtheAuthoritywithinformationorevidencethattheproposedbuildingmeetsthe1991UBC.Basedontheforegoing,theBoardofCommissionersherebydeterminesthat:1.Theproposedrelocationofausedbuildingwhichwillbeusedasabunkhouse(foremployeelodging)withnoinstalledheatorplumbingisinviolationoftheTownMunicipalCodeandthereforeisnotincompliancewiththeEstesParkDowntownRedevelopmentProgram.2.NoevidencehasbeensubmittedthattherelocatedbuildingcompliesorwillcomplywiththeTownBuildingCodenowinforce(UBC-91),andtherefore,thisdevelopmentisnotincompliancewiththeEstesParkDowntownRedevelopmentProgram. 003.TheExecutiveDirectorshallinformtheapplicantofthisdeterminationbytheBoardinwritingwithinthreedays,whichcommunicationshallincludethespecificprovisionsofthePlanwithwhichtheproposeddevelopmentdoesnotcomply.Adoptedthis18thdayofFebruary1993.ESTESPARKURBANRENEWALAUTHORITYChairmanATTEST:
