HomeMy WebLinkAboutEPURA RESOLUTION 176CESTESPARKURBANRENEWALAUTHORITYRESOLUTIONNO.176-92ARESOLUTIONAMENDINGTHEBYLAWSOFTHEESTESPARKURBANRENEWALAUTHORITYCONCERNINGCONFLICTSOFINTERESTWHEREAS,thenoticetoamendthebylawshasbeenprovidedasrequiredinArticleIV,Section1;andWHEREAS,theAuthorityisdesirousofmaintainingthetrustofthecommunityandfunctioningincompliancewithallapplicablelawsandrequirements.NOWTHEREFORE,BEITRESOLVEDBYTHEESTESPARKURBANRENEWALAUTHORITY:ArticleVI,Section3,ofthebylawsoftheEstesParkUrbanRenewalAuthorityisrepealedandreenactedtoprovide:Section3.ConflictofInterest.Nocommissioner,officer,oremployeeoftheAuthority(including,byillustrationonly,consultants,expertsandlegalcounsel),noranyimmediatememberofthefamilyofanysuchcommissioner,officer,oremployeeshallacquire,norshallanycommissioner,officerretainanyinterest,directorindirect,inanyprojectorinanypropertyincludedorplannedtobeincludedinanyproject,norshallhe/shehaveanyinterest,directorindirect,inanycontractorproposedcontractformaterialsorservicestobefurnishedorusedinconnectionwithanyproject.Ifanycommissioner,officeroremployeeoftheAuthorityownsorcontrolsaninterest,directorindirect,inanypropertyincludedorplannedtobeincludedinanyproject,he/sheshallimmediatelydisclosethesameinwritingtotheAuthorityandSecretaryofStateandsuchdisclosureshallbeenteredintheminutesatameetingoftheAuthority.Uponsuchdisclosure,suchcommissioner,officeroremployeeshallnotparticipate,voteorattempttoinfluencethedecisionofanycommissioner,officeroremployeeinanyactionbytheAuthorityaffectingthecarryingoutoftheproject,planning,ortheundertakingoftheprojectunlesstheAuthoritydeterminesthat,inconsiderationofsuchpersonalinterest,theparticipationofsuchmemberinanysuchactwouldnotbecontrarytothepublicinterest.Acquisitionorretentionofanysuchinterestorwillfulfailuretodiscloseanysuchinterestshallconstitutemisconductinoffice. 0Commissioners,officers,consultants,experts,attorneys,representativesandemployeesoftheAuthorityshallalsobesubjecttotheCodeofEthics,Section24-18-101,etq.,ColoradoRevisedStatutes,assuchprovisionsofsaidCodeapplytolocalgovernmentofficials.IntheeventofaconflictbetweentheprovisionsofthefirstparagraphhereinandtheCodeofEthics,theCodeshallprevail.Adoptedthisc2/dayofV,1992.CHAIRNSE2
