A RESOLUTION OF THE ESTES PARK URBAN RENEWAL AUTHORITY
REGARDING THE INTENT TO ACQUIRE REAL PROPERTY AND
AUTHORIZING THE INITIATION OF LEGAL PROCEEDINGS FOR THE
ACQUISITION OF REAL PROPERTY FOR
RIGHT-OF-WAY FOR A PUBLIC STREET
IN THE DOWNTOWN REDEVELOPMENT AREA
WHEREAS,the Estes Park Urban Renewal Authority (Authority)
has negotiated in good faith with the owners of real property
located in Tracts 4 and 5,Stanley Addition to the Town of Estes
Park,Larimer County,Colorado (described in Appendix A hereto)for
the location and acquisition of a public street right—of-way for a
public street;and
WHEREAS,the owners of the real property:W.Brooks Findley
and Wanda E.Findley,FHK Company;The Stanley Hotel:Frank
Normali,General Partner,may not be able to convey clear and
marketable title for the street right-of-way to the Authority;and
WHEREAS,the Authority must have clear title to the subject
property for such use;and
WHEREAS,the Authority is concerned that it may not be able to
acquire clear title without litigation;and
WHEREAS,donation of the property to the Authority was agreed
upon by the said parties at the time of good faith negotiations;
and
WHEREAS,acquisition of the property is necessary for the
construction of a public street to serve the area known as the
Stanley Historic District,created by the Town of Estes Park,
Colorado under Ordinance #16-91;and
WHEREAS,the right-of-way to be acquired is within the Estes
Park Downtown Redevelopment Area;and
WHEREAS,the Authority is authorized by law to initiate and
pursue legal proceedings for the acquisition of the subject
property.
NOW,THEREFORE,BE IT RESOLVED BY THE BOARD OF COMMISSIONERS
OF THE ESTES PARK URBAN RENEWAL AUTHORITY THAT:
The staff,consultants,agents and legal counsel of the
Authority are authorized to initiate and proceed with all
applicable legal actions and procedures,including without
limitation,eminent domain and quiet title,to acquire the real
property described in Appendix A hereto for use as a public street.
ADOPTED this 21st day of May,1992.
