HomeMy WebLinkAboutEPURA RESOLUTION 158C.CRESOLUTIONNO.158ARESOLUTIONOFTHEESTESPARKURBANRENEWALAUTHORITYDECLARINGANINTENTTOACQUIREREALPROPERTYCONSISTINGOFLOTS1AND3,STANLEYKNOLLSUBDIVISIONINTHEDOWNTOWNREDEVELOPMENTAREAANDAUTHORIZINGSTAFFOFTHEAUTHORITYTOINITIATENEGOTIATIONSANDPROCEEDINGSFORSUCHACQUISITIONWHEREAS,inaccordancewithParagraph1oftheEstesParkUrbanRenewalAuthorityResolution157adoptedthe20thdayofDecember1990,whichstates:“1.TheAuthoritywillpurchase,contingentuponProject[RockyMountainFactoryStores]approvalbyapplicablegovernmentalbodies,andpurchaseoftheremainderoftheKnollpropertybythedeveloper,approximatelyfour(4)acresoftheKnollpropertyfromUnitedBankofDenverasopenspace.Suchopenspace,whichmaybeutilizedforpedestrianactivities,includingbutnotlimitedto,walkways,picnicareas,mountainviewingareas,andpedestrianinformationsignage”;andWHEREAS,theRockyMountainFactoryStoresprojecthasbeenapprovedbytheapplicablegovernmentalbodies.NOW,THEREFORE,BEITRESOLVEDBYTHEBOARDOFCOMMISSIONERSOFTHEESTESPARKURBANRENEWALAUTHORITYTHAT:1.TheAuthorityherebydeclaresitsintenttoacquireaparcelofpropertyownedbyUnitedBankofBoulder,beingrepresentedbyUnitedBankofDenver,forpurposesofredevelopment,includingbyillustrationonly,openspace,walkways,picnicareas,mountainviewingareas,pedestrianinformationsignageinaccordancewiththeSecondModificationtotheEstesParkDowntownRedevelopmentProgram,adoptedthe23rddayofOctober1990,whichpropertyisdescribedasfollows:Lots1and3,stanleyKnollSubdivisionofTract2,StanleyAdditiontotheTownofEstesPark,Colorado.2.AcquisitionofsuchpropertyisessentialtofulfillthepublicpurposeofeffectingtheDowntownRedevelopmentProgram(Plan). 003.ThestaffoftheAuthority,includinglegalcounsel,isauthorizedtotakeallnecessarystepsforacquisitionofsuchproperty,includingwithoutlimitation,negotiationswiththepropertyowneroritsrepresentative(s)forsuchacquisition.4.ThisResolutioniscontingentuponthedeveloper’spurchaseofLot2,StanleyKnollSubdivision.ADOPTEDthis7thdayofMarch,1991.ESTESPARKURBANRENEWALAUTHORITYQ.irmanATTEST:Secreary2
