HomeMy WebLinkAboutEPURA RESOLUTION 166RESOLUTION 166 WHEREAS,the Board of Trustees of the Town of Estes Park shall consider a proposed Historic District Ordinance at the July 23, 1991 Town Board meeting,which ordinance is referred to herein as the “Town version”;and WHEREAS,a citizens’initiative ordinance has been proposed and will be submitted to the electorate of the Town on August 6, 1991,referred herein as the “Historic Estes version”;and WHEREAS,significant differences exist between the two versions,such as: A.The Town version does not restrict development size;however,the Historic Estes version restricts any development to a maximum of 6,000 sq.ft.; B.The building materials prohibitions of the Town version are being specific and the Historic Estes version is not specifically designated; C.The Town version is more restrictive on roof designs than the Historic Estes version; D.The Town version of building colors is defined through use of the Munsell color system,while the Historic Estes version does not define the color system as adequately;and WHEREAS,the Town version has specific conditions for parking, landscaping,revegetation,and a submittal of a landscape concept, while the Historic Estes version requires the retention of existing mature trees and significant rock outcroppings which may prevent efficient land utilization;and WHEREAS,the Town version contains specific standards for site and building design,and signage requirements were strengthened. NOW,THEREFORE,BE IT RESOLVED BY THE BOARD OF COMMISSIONERS OF THE ESTES PARK URBAN RENEWAL AUTHORITY THAT: 1.The Board strongly supports the Town version of the Historic District Ordinance because it allows specific,responsible development of historically—oriented properties and also preserves and protects the legal rights of ownership and use of private property. 2.The effect of the Historic Estes version is another attempt to place the issue of the use of a portion of the Knoll property for value oriented commercial uses by private property owners before the voters again,which issue has been earlier resolved by the electors of the Town on February 5,1991. 3.The Historic Estes version may be a taking of the properties or certain property rights of the people affected by the ordinance,which may require the citizens of Estes Park to compensate such property owners through the expenditure of public monies. 4.The Board encourages strong citizen participation for a NO vote on the Historic Estes initiated ordinance on August 6, 1991.
