C)RESOLUTIONNO.165ARESOLUTIONOFTHEESTESPARKURBANRENEWALAUTHORITYDETERMININGTHATADEVELOPMENTKNOWNASTHEMAZEOFTHEROCKIESISNOTINCOMPLIANCEWITHTHEESTESPARKDOWNTOWNREDEVELOPMENTPROGRAMWHEREAS,inaccordancewithSection17.36.020oftheEstesParkMunicipalCode,theproposeddevelopmentknownasTheMazeoftheRockieswassubmittedtotheEstesParkUrbanRenewalAuthority(EPURA)fordeterminationofcompliancewiththeEstesParkDowntownRedevelopmentProgram(Plan);andWHEREAS,anoticeofpublichearingwaspublishedasrequiredbytheMunicipalCode;andWHEREAS,apublichearingwasheldonApril13,1991beforetheEPURABoardofCommissioners;andWHEREAS,allpersonsatsuchhearingwereallowedtopresenttestimonyandevidencetotheBoardofCommissioners;andWHEREAS,theBoardofCommissionershasconsideredallofthetestimonyandevidencepresentedatthehearingandtheproposedplanofdevelopment.NOW,THEREFOREBEITRESOLVEDBYTHEBOARDOFCOMMISSIONERSOFTHEESTESPARKURBANRENEWALTHAT:Basedonthetestimony,comments,andevidencepresentedatthepublichearing,theBoardofCommissionersherebymakesthefollowingfindingsoffact:A.ThePlanprovidesthatthesubjectareaisdesignatedforCommunity—CommercialCenteruse.Assuch,itistoserveasatransitionzonetodowntown,andshouldcontainusesforthe“usual”and“everyday”needsoftheresidentandvisitoronayear—aroundbasisasrequiredbythePlan.Suchusesmayincludelightcommercial,offices,employmentcenters,andprofessionalfacilitiessuchasmedical,dentalandaccounting.EvidencesubmittedbytheapplicantindicatesthatTheMazeoftheRockiesistobeanamusementonly,whichwillnotmeettheyear—aroundeverydayneedsofresidentsandvisitors.B.ThePlanencouragestheredevelopmentoflandandencouragementoflandusesthatgeneratebusinesstostrengthentheeconomicbase,allowforfulleconomicdevelopment,providefinancialstability,andproducetaxrevenuesforthecommunity.1 CSDEvidencebeforethisBoardindicatesthatmunicipalsalestaxgenerationbythisamusementusewillbeminimalandlimitedtothesaleofsouvenirtypeitems,suchasT—shirtsandsweatshirts.ThereisnospecificevidencethatthisusewillstrengthenEstesPark’seconomicbaseandallowforfulleconomicpotentialoftheredevelopmentarea.C.ThePlanemphasizesthattheEstesParkareahasanimageproblemwithmanytouristamusementsandinefficientutilizationofdevelopableland.TheMazeoftheRockiesdoesnotimprovethequalityimageofthecommunityandexemplifiestheinefficientutilizationofland.Basedupontheforegoing,theBoardofCommissionersherebydeterminesthat:1.Theproposedoutdooramusementknownas“TheMazeoftheRockies”isnotincompliancewiththeEstesParkDowntownRedevelopmentProgram(Plan).2.TheproposeddevelopmentisnotincompliancewiththePlan’sgoals,primarilyrelatedtothoseprovisionsregardingLandUtilization,theTransition-Commercial/ServiceDistrict,realizationofsalestaxincrement,andeconomicdevelopmentpotentialofthecommunity.3.AsrequiredbytheEstesParkMunicipalCode,theExecutiveDirectorshallfurnishacopyofthisResolutionandthespecificprovisionsofthePlanreferredtoinparagraph2abovetotheapplicantwithinthree(3)days.ADOPTEDthis2nddayofMay,1991.ATTEST:Secretary2
