HomeMy WebLinkAboutEPURA RESOLUTION 1080RESOLUTIONNO.108(Series1989)ARESOLUTIONOFTHEESTESPARKURBANRENEWALAUTHORITYDECLARINGANINTENTTOACQUIREREALPROPERTYINTHEDOWNTOWNREDEVELOPMENTAREAANDAUTHORIZINGTHESTAFFOFTHEAUTHORITYTOINITIATENEGOTIATIONSANDPROCEEDINGSFORSUCHACQUISITIONWHEREAS,inaccordancewiththeEstesParkDowntownRedevelopmentProgram,theacquisitionofcertainrealpropertiesforredevelopmentforpublicandprivatepurposesisessentialtotheeliminationofblightandtheredevelopmentofthedowntownarea.NOW,THEREFORE,BEITRESOLVEDBYTHEBOARDOFCOMMISSIONERSOFTHEESTESPARKURBANRENEWALAUTHORITYTHAT:1.TheAuthorityherebydeclaresitsintenttoacquireaparcelofpropertyownedbyGene0.Brough,etalforpurposesofredevelopment,includingbyillustrationonly,forpublicparking,publicaccess,openspace,commercialuse,retailuse,orotherusesinaccordancewiththeEstesParkDowntownRedevelopmentProgram,whichpropertyisdescribedasfollows:311—319WestElkhornAvenue,EstesPark,Colorado,alsoknownasthe“OldLumberyard”andmoreparticularlydescribedinthe1988LarimerCountyPropertyFilesasParcelNumbers35252—23—003and35252—23—006.2.AcquisitionofsuchpropertyisessentialtofulfillthepublicpurposeofeffectingtheDowntownRedevelopmentPlan.3.ThestaffoftheAuthority,includinglegalcounsel,isauthorizedtotakeallnecessarystepsforacquisitionofsuchproperty,includingwithoutlimitation,negotiationswiththepropertyowneroritsrepresentative(s),andinitiationoflegalproceedings(exceptcondemnation),ifrequired,forsuchacquisition.ADOPTEDthis5thdayofJanuary,1989.ChairmanATTEST:)ecretary—
