0RESOLUTIONNO.132ARESOLUTIONOFTHEESTESPARKURBANRENEWALAUTHORITYAUTHORIZINGANEXPENDITURE,WITHCONDITIONSFORTHEJOINTPURCHASEOFPROPERTYDESCRIBEDASLOTS31-37,LITTLEPROSPECTADDITIONTOWNOFESTESPARK,LARIMERCOUNTY,COLORADOWHEREAS,theEstesValleyLandTrust,Inc.hasrequestedthattheTownofEstesParkandtheEstesParkUrbanRenewalAuthorityjoinwithEstesValleyLandTrusttopurchaseaparcelofpropertytolieusedforopenspace;andWHEREAS,theEstesParkDowntownRedevelopmentProgramencouragesandauthorizesthepreservationofopenspace;andWHEREAS,theEstesValleyLandTrust,Inc.hasnegotiatedapurchasepriceofFiftyThousandDollars($50,000.00)forthepropertybasedontheTown’sappraisalofthearea,whichpropertyislocatedsouthoftheBigThompsonRiver,anddescribedasLots31-37,LittleProspectAdditiontotheTownofEstesPark,LarimerCounty,Colorado,alsoknownastheLynnGranthillsideproperty;andWHEREAS,theBoardofCommissionershasbeenadvisedthattheuseofEPUPAfundsforthepurchaseofthispropertyislegallypermissible.NOW,THEREFORE,BEITRESOLVEDBYTHEBOARDOFCOMMISSIONERSOFTHEESTESPARKURBANRENEWALAUTHORITYTHAT;InaccordancewiththememorandumfromtheDirectorandAttorneyofEPURA,acopyofwhichdocumentaccompaniesthisResolution,theBoardofCommissionersauthorizetheexpenditureof$20,000,forthejointpurchasewiththeTownofEstesParkandEstesValleyLandTrust,Inc.ofLots31-37,LittleProspectAddition,TownofEstesPark,LarimerCounty,Colorado,alsoknownastheLynnGranthillsideproperty;subjecthowever,totheapprovalbythisBoardofthecontracttopurchase,closingdocuments,deed,restrictivecovenantsandallotherdocumentsrelatedtothistransactionforthepermanentpreservationofthisparceloflandinitsnaturalconditionasopenspace.ADOPTEDthis5thdayofOctober,1989./,:/)--1‘(6-Chairman
