HomeMy WebLinkAboutEPURA RESOLUTION 39RESOLUTIONNO.(Series1985)RESOLUTIONOFTHEESTESPARKURBANRENEWALAUTHORITYAUTHORIZINGTHEINITIATIONOFLEGALPROCEEDINGSFORTHEACQUISITIONOFAPARCELOFREALPROPERTYINTHEDOWNTOWNREDEVELOPMENTAREAWHEREAS,theAuthorityhasnegotiatedingoodfaithwiththerealpropertyowner,TheEstesParkBank,fortheacquisitionofitspropertywithintheDowntownRedevelopmentArea;andWHEREAS,theAuthorityandtheBankhavefailedtoreachagreementoncompensationforthemarketabletitletoitspropertylocatedat101CleaveStreet,EstesPark,Colorado,astheBankcannotconveycleartitletotheAuthority;andWHEREAS,acquisitionofthepropertyisnecessarytoprovidepublicparkingfacilitieswithinthedowntownareaincompliancewiththeEstesParkDowntownRedevelopmentPlan;andWHEREAS,theAuthorityisauthorizedbylawtoinitiateandpursuelegalproceedingsfortheacquisitionofthesubjectproperty.NOW,THEREFORE,BEITRESOLVEDBYTHEBOARDOFCOMMISSIONERSOFTHEESTESPARKURBANRENEWALAUTHORITYTHAT:Thestaff,consultants,agentsandlegalcounseloftheAuthorityareauthorizedtoinitiateandproceedwithallapplicablelegalactionsandprocedurestoacquiretherealpropertyat101CleaveStreet,EstesPark,Colorado.ADOPTEDthis30thdayofJuly,1985./Cairman
