HomeMy WebLinkAboutEPURA RESOLUTION 35CyRESOLUTIONNO.35-85ARESOLUTIONOFTHEESTESPARKURBANRENEWALAUTHORITYAUTHORIZINGTHEACQUISITIONOFPROPERTYLOCATEDAT101CLEAVESTREETWHEREAS,theEstesParkUrbanRenewalAuthorityhasbeennegotiatingtheacquisitionofpropertylocatedat101CleaveStreettobeutilizedforparkingpurposesinaccordancewiththeDowntownRedevelopmentPlan;andWHEREAS,thepropertyownerandtheAuthority’sconsultanthaveproposedtermsofsuchacquisitionfortheapprovaloftheBoardofCommissioners.NOW,THEREFORE,BEITRESOLVEDBYTHEBOARDOFCOMMISSIONERSOFTHEESTESPARKURBANRENEWALAUTHORITYTHAT:Section1.Theacquisitionofthepropertyat101CleaveStreetisherebyapprovedinaccordancewiththefollowingprovisions:A.Thepurchasepriceshallbe$58,500.00cashplusconveyanceoftheparcelknownastheIdaMaeMorrisproperty,whichsaidpropertyhasanappraisedvalueof$70,000.00.B.SellershallconveyclearandmarketabletitletotheAuthority.C.RemovalofallbankpersonalequipmentandpropertywhichincludessignageshallbeeffectedascontainedintheletterofJune13,1985,totheExecutiveDirectorbytheEstesParkBank.D.AllothersuchtermsandconditionsrecommendedbytheAuthority’sattorneyandagreedtobythesellershallbeincorporatedinadocumentforexecutionbytheparties.Section2.TheChairmanisauthorizedtoexecutesuchdocumentonbehalfoftheAuthorityverifyingalltermsofacquisitionandtoexecutealldocumentsorinstrumentsrequiredtoeffectclosingontheproperty.ADOPTEDthis19thdayofJune,1985.L1/ChairmanATTEST:
