A special meeting was called for the purpose of reviewing the
Stanley Village development and to determine whether proposed
changes within the development require an amendment to the plan.
Director Anderson referred to Section 17.76.090 of the municipal
code which states that the Executive Director can waive the TOA
amendment process if it is found that the changes are minor in
nature. However, if the changes are not considered to be minor, the
zoning provides that the URA Board (with the concurrence of the Town
Administrator and Town Planner) may find the changes not substantial
and, therefore, the amendment process may be waived, if it is also
determined that the process would cause serious delays which would
jeopardize the project.
Director Anderson submitted a report to the Board from Staff,
stating that the changes are not substantial and no amendment to the
plan is required. Bill VanHorn was present and explained the
changes outlined on the site plan.
Commissioner Pohl stated, for the record, that the plan was found in
compliance (not approved) on April 3, 1985 and asked that this
be corrected in the first sentence of Staff's memo dated October 8,
1985.
Director Anderson read a letter from Dale Hill, Town Administrator,
dated October 7, 1985 stating it is the Town's opinion that the
changes made are necessary to address either government or
neighborhood demands and that there are no substantial changes from
the approved plan. Also, that further procedural delay would
jeopardize the entire project.
Attorney Windholz recommended that Dale Hill, Town Administrator,
and Steve Stamey, Town Planner, sign the October 8, 1985 URA Staff
memo. This is requested in that the URA Board, with the concurrence
of the Town Administrator and Town Planner can make a determination
based upon the facts — that there are no substantial changes in the
development.
It was moved and seconded (Pohl-Ericson) that the Board accept
Staff's October 8, 1985 recommendation regarding Stanley Village --
that the changes are not substantial and no amendment to the plan is
required. Commissioner Moss questioned zoning and what is
considered major or minor change. Director Anderson said it depends
on the scale of an entire project. Commissioner Pauley suggested
meeting with Phil Herr on his next visit to Estes Park to discuss
possible changes in phraseology of the URA development review
section of the zoning code. With no further questions or discussion,
the motion was carried. The vote was 6-1 with Commissioner Moss
dissenting.
There being no further business, the meeting was adjourned.
