WHEREAS,Ordinance Number 24-86 of the Town of Estes Park
establishes a 2%Use Tax effective the 15th day of December,
1986;and
WHEREAS,Section 3.10.050 of the Ordinance provides that the
Board of Trustees is authorized to adopt all rules and requ—
lations which may be necessary or appropriate for the collection,
and administration and enforcement of the use tax on construction
and building materials;and
WHEREAS,it is necessary to adopt appropriate rules and
regulations for the collection,administration,and enforcement
of the use tax on construction and building materials.
NOW,THEREFORE,BE IT RESOLVED by the Board of Trustees of
the Town of Estes Park,Colorado:
1.That the 2%Use Tax on any construction and building
materials used in the Town of Estes Park shall be
collected by the Town at the time of the issuance of a
building permit.The 2%Use Tax shall be based upon
the estimated amount of materials to be used in the
construction for which the building permit is issued.
2.That the person paying the use tax upon the issuance of
a building permit may obtain a rebate of the use tax
for any sales tax paid on materials for which the use
tax has been collected.
3.That in order to obtain the rebate of the use tax,the
person paying the use tax shall submit to the Town a
Use Tax Rebate Form listing sales tax receipts for the
items upon which the person wishes to claim a rebate of
the use tax.Upon submission and approval of the use
tax rebate form,the person shall be entitled to an
appropriate rebate of the use tax paid on the building
permit.
4.That the Town Finance Officer and Town Building Inspec
tor are hereby authorized by the Board of Trustees to
administer the use tax collection and rebate for the
Town of Estes Park.

BE IT RESOLVED BY THE BOARD OF TRUSTEES OF THE TOWN OF ESTES
PARK,COLORADO:
That the filing date of the application for a 3.2%Beer
License,off premises,to sell malt liquor filed by Estes Park
Enterprises,Inc.,dba PARK WAY FOODS,401 East Elkhorn Avenue,
Estes Park,Colorado,is November 12,1986,and it is hereby
ordered that a public hearing on said application shall be held
in the Board Room of the Municipal Building,170 MacGregor
Avenue,on December 16,1986 at 7:30 P.M.,and that the
neighborhood boundaries for the purpose of said application and
hearing shall be the area included within a radius of 3.08
miles as measured from the center of the applicant’s property.

WHEREAS,Stephen L.Stamey,Town Planner,presented for
adoption,a completely rewritten “state of the art”Residential
Zoning Ordinance;and
WHEREAS,Stephen L.Stamey culminated a process which was
begun two and one—half years ago,devoting many hours to this
project;and
WHEREAS,the Personnel Policies Manual of the Town of Estes
Park provides for special employee incentives in recognition of
“outstanding service.”
NOW,THEREFORE,BE IT RESOLVED BY THE BOARD OF TRUSTEES OF
THE TOWN OF ESTES PARK,that STEPHEN L.STAMEY be awarded $250.00
as a “Special Employee Incentive Award”for his outstanding
service to the Town of Estes Park.

Estes Park Urban Renewal January 22,1985 to succeed Arthur
L.Anderson,whose term expired September 14,1987.Mr.
Ericson’s expiration date was computed to expire September
14,1988.
NOW,THEREFORE,BE IT RESOLVED BY THE BOARD OF TRUSTEES

RESOLUTION NO.21-86
WHEREAS,the Estes Park Urban Renewal Authority is in the
process of the design and construction of a project known as
Streetscape 3 for the purpose of beautifying and improving
Elkhorn Avenue from West Riverside Drive to the intersections of
Highway 36 and Highway 34;and
WHEREAS,said project is in accordance with the provisions
of the Estes Park Downtown Redevelopment Program of May 24,1983;
and
WHEREAS,as a part of said Streetscape 3 certain curb cuts
from properties abutting East Elkhorn Avenue on both the north
and south side of the street shall be closed,relocated,altered,
modified,or allowed to remain as is;and
WHEREAS,Section 12.20.030 of the Municipal Code of the Town
of Estes Park empowers the Board of Trustees of the Town of Estes
Park to determine that any existing curb cut be removed,altered
or decreased;and
WHEREAS,the Board of Trustees of the Town of Estes Park has
reviewed the proposed relocation,modification,closure,
existence and decrease of the following curb cuts;and
WHEREAS,pursuant to the provisions of Section 12.20.030,
the Board of Trustees has determined that unless modified,
altered or decreased,the existing curb cuts interfere with the
proper use of the street as it relates to the Streetscape 3
Project.
NOW THEREFORE,BE IT RESOLVED BY THE BOARD OF TRUSTEES OF
THE TOWN OF ESTES PARK,COLORADO:

4.Property owners affected by this Resolution shall allow
the modification to existing curbcuts 30 days after the service
of this Resolution upon such property owners as provided in
Section 12.20.030 of the Municipal Code of the Town of Estes
Park.

WHEREAS,the Town of Estes Park has determined that it is
necessary to establish an I.C.M.A.Money Purchase Retirement Plan
for the employees of the Police Department;and
WHEREAS,at the time of adoption of the 1986 Budget an
appropriation was not made in an amount sufficient to fund the
transfer of the Police Pension Plan;and
WHEREAS,at the time of adoption of the 1986 Budget it could
not reasonably be foreseen that this pension plan transfer would
need to he funded.
NOW,THEREFORE,IT IS RESOLVED BY THE BOARD OF TRUSTEES OF
THE TOWN OF ESTES PARK,COLORADO,AS FOLLOWS:
1.That the appropriation for the Policemen’s Pension Plan

WHEREAS,the Town of Estes Park maintains a Policemen’s
Pension Fund pursuant to Article 30,Title 31,C.R.S.,1973;and
WHEREAS,the Town desires to enter into an agreement with
the ICMA Retirement Corporation for the purpose of establishing a
money purchase plan and trust;and
WHEREAS,attached hereto as Exhibit “A”and incorporated
herein by reference is the Prototype Money Purchase Plan and
Trust adoption agreement;and
WHEREAS,more than 65%of the employees of the Estes Park
Police Department have voted in favor of adopting the proposed
money purchase plan;and
WHEREAS,the Board of Trustees of the Town of Estes Park
hereby determines that it is in the best interests of the Town
for the adoption of a money purchase plan and trust to be known
as the Estes Park Police Pension Plan in the form of the ICMA
Retirement Corporation Prototype Money Purchase Plan and Trust.

with Western Water Rights,dated the 27th day of May,1986 for
the purchase of 35 units of subdistrict water owned by the Town;
and
WHEREAS,Paragraph 6 of the Contract contains certain
conditions precedent prior to the closing of the agreement;and
WHEREAS,there have been two extensions of the time of
fulfilling of the conditions precedent in paragraph 6e and 6g of
the contract;and
WHEREAS,the closing date of the contract was August 1,
1986;and
WHEREAS,the Town has determined to extend the closing date
of the contract and conditions precedent to August 15,1986;and
WHEREAS,the extension of the closing date to August 15,
1986 necessitates the amendment of certain other provisions of
the contract;and
WHEREAS,the Board of Trustees of the Town of Estes Park has
determined that it is in the best interests of the Town to extend
the contract upon the following terms and conditions.
NOW THEREFORE IT IS RESOLVED BY THE BOARD OF TRUSTEES OF THE

1.The contract dated May 27,1986 between the Town of

WHEREAS,The Town of Estes Park has received written notice
from the Boulder Daily Camera for the placement of newsracks on
the public sidewalks in Estes Park;and
WHEREAS,The Town has been approached by numerous other
newspapers including,but not limited to,the Loveland Reporter
Herald,the Longmont Times Call,the Estes Park Trail Gazette,
the Denver Post,the Rocky Mountain News and USA Today,
indicating a desire to place newsracks upon the public sidewalks
in the downtown area;and
WHEREAS,the Town of Estes Park is considering an ordinance
setting forth the placement,construction and maintenance of
newsracks within the downtown area;and
WHEREAS,certain newspapers have indicated a desire to
attempt to enter into a voluntary understanding regarding the
placement,construction and maintenance of newsracks within the
downtown area;and
WHEREAS,it is necessary to provide temporary locations for
the placement of newsracks in the downtown area on public
sidewalks for an interim period to determine whether or not a
voluntary understanding can be reached concerning said newsracks
in the downtown area;and
WHEREAS,the Town has determined that it is in the best
interests of the Town to provide temporary locations for
placement of newsracks on public sidewalks in the downtown area
under the terms and conditions of this resolution.
NOW THEREFORE,BE IT RESOLVED BY THE BOARD OF TRUSTEES OF
THE TOWN OF ESTES PARK,COLORADO:
1.The Town hereby authorizes the temporary placement of
newsracks at locations within the designated area as more fully
set forth on Exhibit A,attached hereto and incorporated herein
by reference.
2.Each newspaper shall be allowed one (1)newsrack at each
of the locations.
3.Within such designated locations,no newsrack shall be
chained,bolted or otherwise attached to any town—owned fixture
or public way,including but not limited to,street signs,street
lights,benches,planters,traffic control devices,concrete,
brick or asphalt sidewalks within the public right of way.
Newsracks may be voluntarily attached or secured to one another.
Where multiple newsracks exist in a designated area,no newsrack
may be placed or maintained in any position other than next to
another newsrack.
4.This temporary encroachment for newsracks within the
designated locations shall be in effect from June 10,1986
through July 8,1986.
5.This approval for temporary encroachment for newsracks
shall not affect any newsrack presently placed within the
designated area.No other newsrack shall be placed within the

00c.TheBoardoftheMunicipalSubdistrictshallhavegranteditspriorwrittenapprovaloftheacquisitionunderthetermsofthisAgreementoftheUnitsbyWesternWaterintheexpectationthattheunitsshallbesubsequentlyleasedorsoldbyWesternWatertoapersonorentitytoapplytobeneficialusewithinthegeoaraphicalconfinesoftheMunicipalSubdistrict,NorthernColoracoWaterConservancyDistrict,aspermittedbytheBoardunderitsInclusionPolicyofOctober11,1985,orasotherwisehereafterpermitted.d.WesternWatershallhavereachedanagreementwiththeBoardonthetermsandconditionsofaWaterAllotmentContracttobeexecutedbythempriortotheclosingofthisAgreement.e.WesternWatershallhaveconsummatedanagreeablearrangementatitssolediscretionwithaqualifieduseronorbeforeJuly1,1986foraninterimleaseoftheUnits.f.AbonddefeasanceplanandescrowagreeabletoWesternWaterandEstesParkshallhavebeenaccomplishedamongallofthepartiesininterest,suchthat:fi)therepaymentofanycharge,claim,lienorindebtednessoftheSeriesCWaterRevenueBonds,MunicipalSubdistrict,NorthernColoradoWaterConservancyDistrict,oranyearlierseriesofbondsofwhichtheSeriesCbondsconstitutearefunding,isguaranteedthroughthepurchaseofgovernmentobligationsacceptabletoWesternWater,sufficienttopaythedebtserviceobligationsoftheaforementionedSeriesCBondsfortheUnitstransferred;(ii)WesternWatershallhavenofurtherobligation,contingentorotherwise,underthesaidbonds,exceptthroughthetermsofthebonddefeasanceplanandescrowagreement.IntheeventarefundingoftheSeriesCWaterRevenueBondsisaccomplishedpriortotheclosingofthisAgreement,andsaidrefundingenablesEstesParktotransfertheunitstoWesternWater,freeandclearofanycharge,claim,lienorindebtednessoftheSeriesCWaterRevenueBonds,MunicipalSubdistrict,NorthernColoradoWaterConservancyDistrict,oranyearlierseriesofbondsofwhichtheSeriesCbondsconstitutearefunding,therequirementsofthisparagraphforabonddefeasanceplanandescrowshallbewaivedbythepartiesandEstesParkshalltransfertheunitstoWesternWater,freeandclearofanysaidcharge,claim,lienorindebtedness.g.TheAdvisoryBoardofWesternWatershallhaveapprovedthisAgreementonorbeforeJuly1,1986.WithoutlimitinganyotherrightsorremediesWesternWatermayhavewithrespecttothisAgreement,ifanyofthetoregoingconditionsprecedentdonotoccur,arenotsatisfied,orarenotwaivedpriortotheclosingofthisAgreement,oratanearlierdateashereinaboveindicated,WesternWatermayelectnottopurchasetheUnitsandmaycancelthisAgreement,anduponthatelectionthepartiesshallbereleasedfromallfurtherobligationsandliabilitiestoeachother.—4—
007.Closing.TheclosingofthistransactionshalltakeplaceattheprincipalofficesoftheNorthernColoradoWaterConservancyDistrictwithinten(10)daysaftertheapprovalofthetermsofthisAgreementbytheBoardoftheMunicipalSubdistrict,butnotlaterthanAugust1,1986.Thepartiesshallmutuallyagreeupontheexactdateandtimeoftheclosing.Attheclosing,allappropriateadjustmentsshallbemadeuponthepurchasepriceashereinprovidedandthepartiesshallexecute,deliverandexchangealldocumentsrequisitetothecompletedperformanceofthisAgreement.8.AdjustmentofPurchasePrice.ThepurchasepricesetforthinParagraph3isbaseduponthefollowing:a.EstesParkreceivingthesumofTwoMillionNineHundredFifteenThousandDollars($2,915,000.00)cash;b.EstablishmentofabonddefeasanceplanandescrowAgreementinanamountnottoexceedEightMillionFiveHundredThousandDollars($8,500,000.00)cash.Intheeventtheamountnecessarytofundthebonddefeasanceplanandescrowislessthan$8,500,000.00,thepurchasepriceshallbeadjusteddownwardaccordingly,soastoprovideEstesParkwiththesumssetforthinthisParagraph8a.Intheeventthebonddefeasanceplanandescrow,morespecificallysetforthinParagraph6f.ofthisAgreement,entitlesEstesParktoreceiveitsshareofanybondreservefundpresentlyondepositwiththetrusteeoftheSeriesCWaterRevenueBonds,saidshareshallbepaidtoWesternWater,oranappropriateadjustmentofthepurchasepriceshallbemadebythepartiesatclosing.Also,WesternWatershallbeentitledtokeepanysurplusinthebonddefeasanceandescrowplannotnecessarytopaytheobligationsottheSeriesCBonds.9.Default.TimeisoftheessenceofthisAgreement,andintheevent0±anydefaultbyeitherpartyinthetermsandconditionshereof,thefollowingshallapply:a.ByWesternWater.If,priortotheclosing,WesternWaterrefuses,withoutcause,toperformitsobligationsunderthisAgreement,EstesParkshallhavetheright,afterdemanduponWesternWaterandWesternWater’sfailureorrefusaltocomplytherewithwithinareasonabletime,tocancelthisAgreement,retainingthedepositedfundsunderParagraph3a.infullliquidationandsatisfactionofanydamagesitmayhavesustained,inwhicheventtheAgreementshallbeterminatedandneitherpartyshallhaveanyfurtherobligationandliabilitytotheother.ThisshallbeEstesPark’ssoleremedy.—5—

authorized the transfer of certain sums from the General Fund and
the Light and Power Fund to the Water Fund for the purpose of
making the payments on the 1986 Windy Gap assessment;and
WHEREAS,it is the intention of the Board of Trustees of the
Town of Estes Park to have those transferred funds be loans from
the General Fund and the Light and Power Fund to the Water Fund;
and
WHEREAS,it is the intention of the Board of Trustees that
at the time the money is available in the Water Fund to repay the
payments,the appropriate amounts shall be transferred to the
Light and Power Fund and the General Fund unless the Board of
Trustees of the Town of Estes Park determines otherwise;and
WHEREAS,the Board of Trustees has determined that the
amount of payments shall bear an appropriate rate of interest
from the date of the payment.

WHEREAS,the Town has determined that it is necessary to pay
the annual assessment for its water from the Windy Gap Project to
the Municipal Subdistrict of the Northern Colorado Water
Conservancy District;and
WHEREAS,at the time of the adoption of the 1986 Budget an
appropriation was not made in an amount sufficient to pay said
assessment;and
WHEREAS,it is necessary to transfer budgeted and appropri
ated monies from the General Fund and the Light and Power Fund to
the Water Fund;and
WHEREAS,it is necessary to transfer budgeted and appropri
ated monies between line items in the Water Fund to the Windy Gap
Assessment line item.
NOW,THEREFORE,BE IT RESOLVED BY THE BOARD OF TRUSTEES OF
THE TOWN OF ESTES PARK,COLORADO:
1.That the 1986 appropriation for the Water Fund is
hereby increased from $1,147,950.00 to $1,399,950.00
for the purpose of paying the 1986 assessment in the
amount of $762,321.60 to the Municipal Subdistrict of
the Northern Colorado Water Conservancy District.
2.That the sum of $126,000 is hereby transferred from the
General Fund Contingency Fund to the Water Fund for the
purpose of paying the assessment as more fully de
scribed in Section 1 above.
3.That the sum of $126,000 is hereby transferred from the
Light and Power Fund Contingency Fund to the Water Fund
for the purpose of paying the assessment as more fully
described in Section 1 above.
4.That the Windy Gap assessment shall he payable between
April 1 and December 1,1986 in monthly installments.
That the actual transfer of the aforementioned funds
shall be made at the time the assessments are actually
due and owing to the Municipal Subdistrict and that all
monies budgeted for said payments in the Water Fund
have been paid.

WHEREAS,the Town desires to appoint the ICMA Retirement
Corporation as Agent for the Town for the purpose of investing
the assets of said policeman’s pension fund;and
WHEREAS,the ICMA Retirement Corporation has indicated its
desire to be appointed Agent for the Town pursuant to the terms
and conditions of an agreement between the Town and ICMA
Retirement Corporation,a copy of which is attached hereto.

WHEREAS,the Town of Estes Park acquired certain real
property from the Public Service Company of Colorado;and
WHEREAS,the Board of Trustees of the Town of Estes Park has
determined that a 6 acre portion of said property should be sold;
and
WHEREAS,the Board of Trustees has determined that the offer
in the form of a real estate contract attached hereto as Exhibit
“A”and incorporated herein by reference,is acceptable to the
Board of Trustees;and
WHEREAS,the Board of Trustees further finds that the sale
of the 6 acres under the terms and conditions of said real estate
contract represents a sale of the property for full and fair
value;and
WHEREAS,the Board of Trustees has determined that the Estes
Park Memorial Gardens,Inc.,a non—profit cemetery corporation,
is an appropriate party to sell said real property to under the
terms and conditions of said real estate contract;and
WHEREAS,the Board of Trustees hereby determines that it is
in the best interests of the town that said property be sold to
the Estes Park Memorial Gardens,Inc.,under the terms and
conditions of the real estate contract.
NOW,THEREFORE,BE IT RESOLVED BY THE BOARD OF TRUSTEES OF
THE TOWN OF ESTES PARK,COLORADO:
1.The Board of Trustees hereby approves the execution of
the real estate contract attached hereto as Exhibit “A”and
authorizes the mayor and clerk to execute the same.
2.Pursuant to the provisions of Section 31—15-713(1)(a),
C.R.S.1973,the Board of Trustees hereby directs that the
question of the sale of the property under the terms and
conditions of the real estate contract shall be submitted to the
registered electors of the Town of Estes Park at the next regular
election on April 1,1986.
3.The Board of Trustees hereby authorizes and directs the
Town Clerk to prepare the notice and ballot for presentation of
the question to the registered electors on April 1,1986.

RESOLUTION 4-86
WHEREAS,by the Statutes of the State of Colorado,the 1st
day of April,1986 is fixed as the time for the election of three
Trustees of the Town of Estes Park;and
WHEREAS,it is the duty of the Board of Trustees to provide
for holding such election.
WHEREAS,Section 31-10-401 C.R.S.1973,allows the Board of
Trustees to delegate to the Clerk,by Resolution,the authority
and responsibility to appoint the Judges of Election.
NOW,THEREFORE,BE IT RESOLVED that an election for the
purpose of electing three Trustees shall be held on Tuesday,
April 1,1986;
BE IT FURTHER RESOLVED,that the polling place shall be in
the Board Room of the Municipal Building,170 MacGregor Avenue,
Town of Estes Park,Colorado;and that the polls shall be open
from 7:00 A.M.to 7:00 P.M.on said election day.
BE IT FURTHER RESOLVED,that voting machines shall be used
in the Municipal Election and that the Town Clerk be and she is
hereby authorized and directed to perform all acts and functions
necessary for the use of such voting machines as required by the
laws of the State of Colorado pertaining thereto.
BE IT FURTHER RESOLVED,that pursuant to Section 31-10-401
C.R.S.1973,the Board of Trustees delegate to the Town Clerk,by
Resolution,the authority and responsibility to appoint the
Judges of Election.
BE IT FURTHER RESOLVED,that the Judges of Election appoint
ed by the Town Clerk shall receive for their services the sum of
sixty dollars ($60.00).
BE IT FURTHER RESOLVED,that the Town Clerk be authorized to
give notice of the election by publication as provided by law.
BE IT FURTHER RESOLVED,that the Town Clerk shall,at the
expense of the Town,arrange for such materials and supplies for
such election as may be necessary.

WHEREAS,Larimer County,Colorado has prepared a plan for
the identification,inventory,development and maintenance of
trails in the Estes Valley area,known as the Estes Valley Trails
Plan;and
WHEREAS,said Plan has been considered by the Planning
Commission of the Town of Estes Park as an addition to the Estes
Park Comprehensive Plan of May 17,1977;and
WHEREAS,the Planning Commission has held a public hearing
on the addition of the Estes Valley Trails Plan to the Estes Park
Comprehensive Plan;and
WHEREAS,not less than two thirds of the entire membership
of the Planning Commission has voted to amend the Estes Park
Comprehensive Plan by the addition of the Estes Valley Trails
Plan;and
WHEREAS,§31-23—208,C.R.S.,1973,provides that said
addition to the Estes Park Comprehensive Plan of May 17,1977
requires the approval of the Board of Trustees of Estes Park.
NOW THEREFORE,IT IS RESOLVED:
1.That the Estes Park Comprehensive Plan of May 17,1977
be amended by the addition of the Estes Valley Trails Plan to
said Comprehensive Plan.

WHEREAS,it is in the best interests of National,State,and
Local Governments to encourage energy conservation and promote
the use of renewable energy resources;and
WHEREAS,the Western Area Power Administration,through the
Federal Register,has announced its final amended guidelines and
acceptance criteria for customer conservation and renewable
energy programs;and
WHEREAS,the Town of Estes Park wishes to demonstrate
affirmative promotion of all energy conservation measures.
NOW,THEREFORE,BE IT RESOLVED by the Board of Trustees of
the Town of Estes Park that the Light and Power Department and
the citizens within its electric service area be encouraged and
supported in all endeavors to create and maintain effective and
renewable energy programs.
