Mayor Dekker opened the meeting at 3:31 p.m.
PRESENTATION - ESTES VALLEY LAND TRUST (EVLT).
Member Jim Crain acknowledged his fellow members Ken Oldham, Jim White and
Wendell Amos, recognized Trustee Hix for his contributions, and provided background
information on the Land Trust. The EVLT’s mission is to preserve the character of the
Valley, entryways, etc. Over the past 12 years, EVLT has assisted in preserving 3,800
acres. Funding from GoCo grant funds, donations, gifts, etc. have been significant, and
future GoCo funding in the amount of $55-67,000,000 is available for open space
acquisition. GoCo grants are provided throughout the state.
The EVLT previously submitted a proposal to preserve the Knoll and Willows properties
as they are unique. Town Administrator Widmer assured the EVLT the proposal was
not being ignored, rather, due to future implications, the Town is reviewing its options.
Mayor Dekker expressed the Board’s appreciation for the presentation, adding that the
entire community is benefiting from the work being accomplished by the EVLT.

Town Attorney White stated that the first draft of the Development Code is virtually
complete, thus the goal of the Estes Valley Planning Commission reviewing the final
draft by March 31st is assured.
The purpose of this meeting is to give the Trustees an overall briefing of the zoning
changes, review new concepts, and obtain comments.
Staff commented on the Comprehensive Plan, adoption process, current status of the
EVDC, and thoroughly reviewed each chapter of the draft.
The Town Board directed staff review the following:

The 50’ river setback.
Including Highway 7 in the “highway corridor” criteria relative to prohibitive
materials.
Increasing the restriction for employee housing from 10 years to 20 years.
Requiring non-conforming structures with 50% or more damage to rebuild as
conforming structures.
Ridgeline Protection Standards pertaining to setback.
Land dedication - In-Lieu fee (adding costs for the developer)
Affordable Housing Density Bonus formula of up to 50% - include data from the
RRC Study, if available.

A brief discussion followed on the “transfer of development units” (TDU’s) with staff
confirming that Larimer County is supportive of this concept.
Staff outlined the Operational IGA with Larimer County and the Board of Adjustment.
Legislation is now in place for the new Board of Adjustment which will replace the
separate Town and County Boards of Adjustment. In summary, Trustee Barker voiced
his objection to this proposal based on retaining the citizen’s right to a local board;
election of the Trustees by the residents; and how a tie-vote which, in his opinion, could
frequently occur, would result in denial. Control should be maintained locally, if not,
appeals would be heard in District Court. Trustee Baudek stated he supports the new
Board of Adjustment jf there is equal representation by both the Town and the County.
Trustee Doylen provided counter-point stating that if two boards are retained, the result
will be two interpretations, thus encouraging a division between the Town and County—
the goal is to unify planning in the entire Valley.
Town Attorney White urged that the EVDC move forward, confirming that the code may
be amended as needed. Director Stamey confirmed that a joint study session between
the Town Board and County Commissioners will be planned in April to discuss the
review process and adoption schedule.
Mayor Dekker expressed the Board’s appreciation to Attorney White and Director
Stamey on ensuring that the EVDC continues forward.
Mayor Dekker adjourned the meeting at 8:15 p.m.
