Chairman Sager called the meeting to order at 9:00 A.M.
1. MINUTES
Minutes of the June 16, 1992 meeting were approved as
submitted.
2. SPECIAL REVIEW
2.A. Revised Special Review 92-2. Elkhorn Lodge, Trout Pond,
Associated Property Consultants, Applicant.
/?(3 7w Applicant proposes to construct a private fishing pond for
Elkhorn Lodge guests in the area north of the main lodge, east
of the stables, and along Fall River. The pond is
approximately 1/2 acre in surface area and 4 ft* deep and
would be filled through diversion from, and with an outlet
into. Fall River.
Chairman Sager opened the public hearing. Staff advised the
Committee of the following:
The land is located in a sensitive visible area of the
property. Existing willows and river vegetation should
not be removed.
2. Twelve parking spaces (gravel surface) have been shown.
The applicant is proposing to constrict a fee building
and, prior to construction of this building,_ the moved-in
log structure should be removed from the site.
3. Streets and utilities serving the site are adequate.
4. The Colorado Division of Water Resources has commented on
the requirement for a water court decree and water
augmentation plan.
Staff noted the C-0 District objectives, i.e. (1) develop in
ways integrating and even enhancing the quality of streams and
rivers; (2) build a clear identity along the approaches to the
Town's center.
Chairman Sager closed the public hearing.
Staff noted its concern with respect to pond maintenance and
recommended that approval of Special Review 92-2 be contingent
upon the following:

Removal (from the site) of the moved-in building.
Compliance with Division of Water Resource requirements
prior to pond construction. A letter from the Division
of Water Resources needs to be submitted to the Town to
verify this compliance.
A floodplain development permit be required for
inlet/outlet construction. Concrete head walls be used
per Public Works.
Existing willows on either side of the outlet not be
removed.
Coordinate construction with Estes Park Sanitation
District.
The Planning Commission expressed concern regarding development of
the site in a piece-meal fashion and indicated that a concept plan
for the entire Elkhorn Lodge property should be developed. It was
moved and seconded (Wexler-Wood) this item be continued to August
18, 1992 with the recommendation that the Applicant provide a
concept plan for the entire Elkhorn Lodge property, said concept
plan to include, and it passed unanimously:
1. Deletion of the portion of the pond that encroaches into
the 25' setback;
2. Riveirwalk opportunities (e.g. easement);
3. Identification of proposed signage;
4. A wildlife biologist's opinion regarding adequacy of the
pond to support fish life;
5. Parking layout and demand for the site and uses.

Claudia Cuneo. Applicant.
Sharon Anfield/Anfield Planning Services, representing the
Applicant, noted the subject site is less than 1/2 acre in
size, located approximately 3/4 miles south of Town limits,
and accessed by Strong Avenue, a private street. The general
character of the area is tourist accommodations/activities and
single-family. Applicant is requesting a rezoning from E-1
Estate to T-Tourist, citing that T-Tourist zoning would be
consistent with the surrounding area and the proposed use of
tourist housing would provide needed, additional housing for
the growing tourist economy in Estes Park. Applicant is
proposing to build a cabin approximately 20' x 25' in size,
next to an existing cabin, and install public sewer service to
both structures.
Helen Longworth, neighbor, stated she is opposed to an
additional cabin at this location because of the site size and
proposed sewer installation across her property. Charlotte
Tagg, neighbor, noted that residents had petitioned for and
received, E-1 Estate zoning, thus eliminating increased
tourist/accommodation services in the area. Chairman Sager
cited Larimer County's definition of T-Tourist which indicates
no limit to the number of buildings an individual can
construct on this size lot, and also read allowable uses.
It was moved and seconded (Brown-Burgess) the Planning Commission
recommend to Larimer county, denial of this application based upon
the information presented, expansion of T-Tourist zoning is not
appropriate, the lot's small size, and the lot is not on an
arterial street, and it passed unanimously.

NORTH END PROPERTY OWNER'S REZONING REQUEST
Staff reported that the revised proposal has incorporated several
concerns of the Estes Park Planning Commission. Commissioner Brown
suggested the Town initiate a water rate structure for property
owners of larger lots, ensuring these owners pay their fair share
for increased usage because of lot size. Chairman Sager
recommended Exhibit A's Item D-Guest Houses be either singular or,
the number be limited on each property.
